Board of Appeals George J. Devlin SP-93-68 2 .
The Board of Appeals made the following findings:
1 . the changes between the proposed dwelling and the
prior one are insubstantial although the proposed
structure will result in a reduced side-yard setback
thereby increasing the non-conforming nature of the
structure. As a result this Board is required to
make a determination under M.G.L.Ch. 40A, Section 6,
regarding substantial detriment.
2. the immediate neighborhood consists of one-story and
two-story single family homes of similar size and
style to the proposed structure. The proposed
structure conforms to all applicable setbacks with
the exception of the sideyard requirement and exceeds
the frontyard setback of many existing homes in the
neighborhood. The proposed structure includes a new
(Title V) septic system and meets the current height
and lot coverage requirements. Accordingly we find
that the proposed changes will not result in a
structure or use which is! more detrimental to the
neighborhood than the prior non-conforming structure
and its use .
3 . the plans of' the proposed structure, its location on
the lot, and the intended use of the structure comply
with the general provisions set forth within the
by-laws .
