Board of ,Appeals E. Thomas Jones SP-93-63 5 . <br /> 25 . The subject property also is entitled to the <br /> separate lot protection of Section 6 of Ch. 40A <br /> based upon: <br /> a. the lot is for single family residential use . <br /> b. which, at the time of its recording or <br /> endorsement <br /> C . was not held in common ownership with any <br /> adjoining land ( see referenced deeds above ) <br /> d. conformed to then existing requirements , and <br /> e . meets applicable square footage requirements <br /> and frontage requirements ( see footnote one of <br /> Land Space Requirements Table, Section <br /> 174-31 ) . <br /> 26 . The use is in harmony with the general purpose and <br /> intent of the Zoning By-laws and complies with the <br /> provisions therein. <br /> In view of the foregoing, the Board of Appeals has <br /> determined that because the subject property is entitled to <br /> separate lot protection under M.G.L. Chapter 40, Section 6, <br /> a single-family residence may be constructed on the property <br /> without necessity for the requested special permit . <br /> Notwithstanding this determination, the Board has also <br /> decided that- the improvement of the subject property with a <br /> single-family residence meets the criteria for a special <br /> permit under Section 174-17 . <br /> Upon motion duly made and seconded the Board of Appeals <br /> voted unanimously on January 26 , 1994 to grant the Special <br /> Permit. <br />
