Board of Appeals E. Thomas Jones SP-93-63 4 . <br /> 17 . The following provisions of Massachusetts General <br /> Laws and the Mashpee Zoning By-law are applicable : <br /> a. General Laws, Chapter 40A, Section 6, P. 2 <br /> b . General Laws, Chapter 40A, Section 6, P. 4 <br /> c . Section 174-17 of the Mashpee Zoning By-law <br /> d. Section 174-21 of the Mashpee Zoning By-law <br /> 18 . The proposal for the subject property will provide <br /> only for a single family residence with accessory <br /> uses without detracting from the surrounding <br /> area. <br /> 19 . The area of the subject property is 13, 100 square <br /> feet . In accordance with Section 174-28 and Sec. <br /> 174-31 , no more than 20% of the gross land area <br /> will be covered by the single family residence to <br /> be constructed. <br /> 20 . In accordance with Sec . 174-31 , the single family <br /> residence will not exceed 2 1/2 stories or a height <br /> of 35 feet . <br /> 21 . The Building Inspector has determined that the <br /> proposed single family residence will meet all <br /> applicable dimensional requirements . <br /> 22 . There is adequate land area to provide sufficient <br /> parking and setbacks as required. <br /> 23 . Daniel ' s Island Road is adequate to carry any <br /> additional traffic to be generated by the <br /> improvement of the site with a single family <br /> residence . <br /> 24 . The proposed use of the subject property through <br /> change, intensification, extension or enlargement <br /> by construction of a single family residence shall <br /> not be substantially more detrimental to the <br /> neighborhood than the existing use. <br /> 4� . <br /> I <br />
