Board of Appeals James B. & James M. Gamble 2 . <br /> The Board of Appeals made the following findings: <br /> 1 . the changes between the proposed dwelling and the <br /> prior one will result in' a reduced side-yard setback <br /> and lot coverage thereby increasing the <br /> non-conforming nature of the structure . As a result <br /> this Board is required to make a determination under <br /> M.G.L.Ch. 40A, Section 6 , regarding substantial <br /> detriment. <br /> 2 . the immediate neighborhood consists of one-story and <br /> two-story single family homes of similar size and <br /> style to the proposed structure. The proposed <br /> structure conforms to all applicable setbacks with <br /> the exception of the sideyard requirement and exceeds <br /> the frontyard setback of many existing homes in the <br /> neighborhood. The proposed structure includes a new <br /> (Title V) septic system and meets the current height <br /> requirements . Accordingly we find that the proposed <br /> changes will not result in a structure or use which <br /> is more detrimental to the neighborhood than the <br /> prior non-conforming structure and its use . <br /> 3 . the plans of the proposed structure, its location on <br /> the lot, and the intended use of the structure comply <br /> with the general provisions set forth within the <br /> P` by-laws . <br />
