V-93-96 <br /> 287 Hooppole Map 49 , Block 112 <br /> A Petition was filed by Donald H. Priestly of Mashpee, <br /> Massachusetts for a Variance from Section 174-31 of the <br /> Zoning By-laws for permission to vary the lot size, frontage <br /> and setback requirements in an R-5 zoning district to allow <br /> construction of a new single family home at 287 Hooppole <br /> Road (Map 49 , Block 112 ) Mashpee , Massachusetts. (Owner of record: <br /> Elaine L. Capozzoli) . <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws Chapter 40A. Notice was given by <br /> publication in The Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee on October 22 and October <br /> 29 , 1993 , a copy of which is attached hereto and made a part <br /> hereof . <br /> A Public Hearing was held on the Petition at the <br /> Mashpee Town Hll on Wednesday, November 10 , 1993 at 7 :30 <br /> P .M. at which time the following members of the Board of <br /> Appeals were present and acting throughout: John J. Friel , <br /> Michael A. Makunas and Edward M. Govoni . <br /> Attorney Steven Murphy represented the applicant. He <br /> explained that the owner had purchased three lots in the <br /> area in 1974 and has been trying to sell them for the past <br /> two years . He informed the Board that the zoning had <br /> changed in 1989 and that the area was now served by the <br /> Mashpee Water District . Comments were received from <br /> residents of the area in favor of the construction of a <br /> house on this !at but opposed to construction on each of two <br /> other lots on Hilltop Road under the same ownership. <br />
