MA 02649 <br /> Decision <br /> for a Special Permit <br /> RE: Steven Politi for a Special Permit SP-92- 12 <br /> A Petition was filed by Steven Politi of Boston, <br /> Massachusetts for a Special Permit under Section 174-25 . I . 9 <br /> of the Zoning By- laws for permission to construct an <br /> elevated walkway to allow access to a relocated existing <br /> seasonal ramp, pier and floats in Popponesset Creek in an <br /> R-3 zoning district on property located at 133 Popponesset <br /> Island Road ( Map 112, Block 17 ) Mashpee, MA. ( Owner of <br /> record : Ann R . Politi ) . <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws Chapter 40A. Notice was given by <br /> publication in The Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee on March 6 and March 13, <br /> 1992, a copy of which is attached hereto and made a part <br /> hereof . <br /> A Public Hearing was held on the Petition at the <br /> Mashpee Town Hall on Wednesday, March 25, 1992 at 7 : 30 P. M. <br /> at which time the following members of the Board of Appeals <br /> were present and acting throughout : Michael A . Makunas, <br /> John J . Friel and Edward M. Govoni . <br /> Attorney Michael Ford, Wetland Consultant Mario <br /> DeGregorio, and Engineer Roger Michniewicz represented the <br /> Applicant . , They presented plans of the existing pier, ramp <br /> and float and an affidavit confirming the construction in <br /> 1981 . They explained that they are seeking licensing for a <br /> Chapter 91 waterways license and a Section 10 permit from <br /> the Corps of Engineers . They informed the Board that both <br /> federal and state regulations prohibit any structure to be <br /> within 25 ' of a property line and require a 5 ' elevation <br /> above the inter-tidal area. As a result, the structure will <br /> be relocated and elevated to meet the requirements . <br /> The project proposal includes the construction of a <br /> 104 ' elevated walkway from the existing dwelling to the <br /> relocated pier, ramp and floats . This will be elevated 5 ' <br /> over the marsh to allow recreational foot traffic beneath it <br /> and also to ' render sufficient sunlight penetration to the <br /> marsh grasses beneath . Comments were received from the <br /> Conservation Commission in favor of the project . No <br /> comments were received from abutters . <br />
