Board of Appeals Steven Politi - SP-92- 12 2 . <br /> Zoning Enforcement Officer Douglas S . Boyd confirmed <br /> that structures listed in Section 174-25 . I . 9 were measured <br /> from the high water mark seaward in determining overall <br /> length, a length not to exceed 701 . The high water mark <br /> designated on the Politi plan is the rack line of highest <br /> I ( spring ) tidal water and is the starting point for the <br /> measurement of the structure . The area of the salt marsh <br /> landward of this mark ( rack line at spring high tide ) is not <br /> included for the purposes of determining the length of the <br /> structure . <br /> The Board made the following findings : <br /> 1 . the high water mark is the rack line at spring tide <br /> and finds that so much of the salt marsh that is covered by <br /> the water with the spring high tide is included for the <br /> purposes of measurement . <br /> 2 . the portion of the float, pier and ramp that extend <br /> seaward from the high water mark does not exceed the maximum <br /> length as defined in the Mashpee Zoning By-laws . Variance <br /> relief is not required . <br /> 3 . the salt marsh indicated on the plan is a marsh <br /> subject to coastal storm flowage and is not subject to tidal <br /> action. <br /> 4 . the structure will not interfere with free passage <br /> of travel by water or land or cause or contribute to the <br /> substantial disruption or degradation on the marine or <br /> coastal environment . <br /> 5 . the proposed design will reduce foot traffic <br /> through the marsh, removing long-term impacts to vegetation. <br /> 6 . the use is in harmony with the general purpose and <br /> intent of the zoning by- laws <br /> 7 . the use complies with the provisions of the by-law. <br /> 8 . the extension and change shall not be a detriment <br /> to the surrounding neighborhood . <br /> Upon motion duly made and seconded the Board of Appeals <br /> voted unanimously on March 25, 1992 to grant the Special <br /> Permit . The Permit is referenced by plans of Eagle <br /> Surveying Project 91 -062 . <br />
