retail activities, including a flea market, a miniature. golf <br /> course, and a restaurant/snack bar type of business . <br /> 6 . The property is situated in the C-1 Zoning District, <br /> which is defined by Section 174-4 of the Zoning By-Laws as a <br /> commercial district. <br /> 7 . The proposed uses of the premises are consistent with <br /> the uses allowed by Section 174-25 of the Zoning By-Laws upon the <br /> grant of a Special Permit by the Zoning Board of Appeals . <br /> 8. Since 1984, the Applicant has applied for and received <br /> on a renewable basis a Special Permit (SP-84-03-01) and renewal <br /> of that Special Permit to engage in the aforementioned activities <br /> (in particular, the flea market) on the Owner's parcel . <br /> 9 . Again in January 1992 , the Applicant sought a renewal <br /> of the previously granted Special Permit to engage in the afore- <br /> mentioned activities on the Owner's land. <br /> 10. On or about February 26 , 1992 , a public hearing was <br /> held at the Mashpee Town Hall . <br /> 11. That public hearing was continued to March 11, 1992 , at <br /> which time the Board of Appeals voted to grant the renewal of the <br /> Special Permit subject to the imposition of certain conditions . <br /> 12 . A number of conditions were imposed which go beyond <br /> conditions previously imposed by the Board, and which in the <br /> pinion of the Owner, go beyond the authority vested in the <br /> pecial Permit granting authority. <br /> 13. Those conditions include, but are not limited to: <br /> (a) A condition that the Permit expire on August <br /> 3, 1992 unless the Applicant can demonstrate <br /> 3 <br />
