Board of Appeals Little River Boatyard 2 . <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws Chapter 40A on the continuation of <br /> the Board of Appeals hearing . Notice was given by <br /> publication in the Enterprise on April 30, 1991 and May 7, <br /> 1991, a copy of which is attached hereto and made a part <br /> hereof . <br /> The public hearing was continued on Wednesday, May 15, <br /> 1991 at 7 : 30 P. M . at the Mashpee Town Hall at which time the <br /> following members of the Board of Appeals were present and <br /> acting throughout : Cheryl A. Hawver, Michael A . Makunas, <br /> William J . Hanrahan, Edward M. Govoni, John J . Friel and B. <br /> Thomas Christian. <br /> Attorney John Connolly represented the applicant and <br /> presented plans for the reconstruction of a boat storage rack <br /> building . He informed the Board that the Cape Cod Commission <br /> had directed that 40 ' be removed on the Riverside Avenue side <br /> of the building and a bermed containment system would be <br /> installed . <br /> Comments were received from Mashpee residents in favor <br /> of and opposed to the Petition . <br /> FINDINGS <br /> The Board of Appeals, after carefully considering all of <br /> the facts and evidence submitted at the hearing, makes the <br /> following findings : <br /> 1 . Under the current Zoning By- law sections 174-25 . E. 5 <br /> provides that "marinas" are permitted in districts <br /> R-3 and R-5 by Special Permit . <br /> 2 . Section 174-3, in defining a "Marina" imposes the <br /> requirement that ' . . . if storage is to be on land <br /> and of a transient nature requiring frequent <br /> launchings and landings, it shall be inside a <br /> building" . <br /> 3 . A "Building" under section 174-3 includes the word <br /> "structure" which by definition shall also <br /> mean a three dimensional enclosure . . . " . <br />
