MA 02649 1 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: Arnold J. and Carolyn S. Kroll for a Special Permit SP-91-41 <br /> A Petition was filed by Arnold J. and Carolyn S. Kroll of Weston, <br /> Massachusetts for a Special Permit under Section 174-25.1.9 of the <br /> Zoning By-laws for an existing pier, ramp and float in an R-3 zoning <br /> district on property located at 212 Daniel's Island Road (Map 100, <br /> Block 26) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on July 5 and July 12, 1991, a copy of which is attached hereto and <br /> made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, July 24, 1991 at which time the following members <br /> of the Board of Appeals were present and acting throughout: <br /> William J. Hanrahan, Michael A. Makunas and John J. Friel. <br /> Engineer Stephen A. Wilson represented the applicant and <br /> presented plans of the existing dock which the owner was licensing <br /> under the amnesty program. Board Members had visited the site and <br /> discussed the fact that the dock ended in shallow water. Paul <br /> Somerville, Shellfish Constable, expressed concerns on the shallow <br /> water and the height of the structure. Revised plans were submitted <br /> providing steps over the dock with the approval of the Conservation <br /> Commission. No comments were received from abutters. <br /> Upon motion duly made and seconded the ,Board of Appeals voted <br /> unanimously on September 11, 1991 to grant the Special Permit. The <br /> permit is referenced by plans of Levy, Eldredge & Wagner Associates Inc. <br /> revised 9/25/91. <br />
