MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: Francis E. and Jean M. Hassey for a Special Permit SP-91-40 <br /> A Petition was filed by Francis E. and Jean M. Hassey of Mashpee, <br /> Massachusetts for a Special Permit under Section 174.25.I.9 of the - <br /> Zoning By-laws for an existing pier, ramp and float in an R-3 zoning <br /> district on property located at 36 Little Neck Lane (Map 105, Block 11) <br /> Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, <br /> on July 5 and July 12, 1991, a copy of which is attached hereto and <br /> made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, July 24, 1991 at 7:30 P.M. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: William J. Hanrahan, Michael A. Makunas and John J. Friel. <br /> Engineer Stephen A. Wilson represented the applicant and explained <br /> that they are seeking a Chapter 91 Waterways License under the amnesty <br /> program. He reviewed plans of the dock, float and ramp which have <br /> been on the site since 1957. No objections were received from the <br /> Shellfish or Conservation Commissions. <br /> The Board found that the use is in harmony with the general <br /> purpose and intent of the Zoning By-laws and complies with the <br /> provisions therein. The Board determined that the structure would <br /> .not unduly interfere with free passage of travel by water or land <br /> or cause disruption to the marine or coastal environment. <br />
