MASHPEE BOARD OF APPEALS PROCEDURES - 2 <br /> c. Design Review Committee - for any commercial development <br /> d. Mashpee Water District - for any commercial development in <br /> the Groundwater Protection District <br /> ABUTTER'S LISTS <br /> Massachusetts General Laws Chapter 40A, Section 11, requires that <br /> abutters and abutters to the abutters within 300 feet of the <br /> property line be notified of the Public Hearing on all Applications. <br /> The Applicant is not responsible for the preparation of this list. <br /> The Mashpee Assessor's office will prepare the certified list of <br /> abutters and the Board of Appeals office will process the mailing. <br /> A charge of $2.00 per abutter name will be billed to the Applicant <br /> for computer time, postage, supplies and processing costs. <br /> Applicants are advised to review their proposed plans with their <br /> immediate neighbors prior to the Public Hearing. <br /> PUBLIC HEARINGS <br /> A Public Hearing will be scheduled within 65 days from the date <br /> the Application was filed with the Town Clerk. The Board of Appeals <br /> normally meets on the second and fourth Wednesday of the month at <br /> 7:30 p.m. at the Mashpee Town Hall. The Applicant or his Agent <br /> should be present at the hearing. <br /> ZONING BY-LAWS <br /> All Applications must include reference to the Section of the <br /> Zoning By-law which allows either a Special Permit or a Variance. <br /> The Zoning By-laws of the Town of Mashpee have been re-numbered <br /> effective January 1, 1990. All Applicants are advised to refer <br /> to the new By-laws to insure reference to the proper sections. <br /> Copies of the By-laws are available in the office of the Town Clerk. <br /> ZONING ENFORCEMENT OFFICER <br /> The Building Inspector is the Zoning Enforcement Officer for the <br /> Town of Mashpee. Applicants may consult with him on questions <br /> of need for Special Permits or Variances. <br /> CHAPTER 593 OF THE ACTS OF 1989 <br /> The Mashpee Board of Appeals has adopted the provisions of Chapter 593 <br /> of the Acts of 1989 relative to the Establishment of Special Accounts <br /> for consultant fees. <br />
