MASHPEE BOARD OF APPEALS PROCEDURES - 2 c. Design Review Committee - for any commercial development d. Mashpee Water District - for any commercial development in the Groundwater Protection District ABUTTER'S LISTS Massachusetts General Laws Chapter 40A, Section 11, requires that abutters and abutters to the abutters within 300 feet of the property line be notified of the Public Hearing on all Applications. The Applicant is not responsible for the preparation of this list. The Mashpee Assessor's office will prepare the certified list of abutters and the Board of Appeals office will process the mailing. A charge of $2.00 per abutter name will be billed to the Applicant for computer time, postage, supplies and processing costs. Applicants are advised to review their proposed plans with their immediate neighbors prior to the Public Hearing. PUBLIC HEARINGS A Public Hearing will be scheduled within 65 days from the date the Application was filed with the Town Clerk. The Board of Appeals normally meets on the second and fourth Wednesday of the month at 7:30 p.m. at the Mashpee Town Hall. The Applicant or his Agent should be present at the hearing. ZONING BY-LAWS All Applications must include reference to the Section of the Zoning By-law which allows either a Special Permit or a Variance. The Zoning By-laws of the Town of Mashpee have been re-numbered effective January 1, 1990. All Applicants are advised to refer to the new By-laws to insure reference to the proper sections. Copies of the By-laws are available in the office of the Town Clerk. ZONING ENFORCEMENT OFFICER The Building Inspector is the Zoning Enforcement Officer for the Town of Mashpee. Applicants may consult with him on questions of need for Special Permits or Variances. CHAPTER 593 OF THE ACTS OF 1989 The Mashpee Board of Appeals has adopted the provisions of Chapter 593 of the Acts of 1989 relative to the Establishment of Special Accounts for consultant fees.
