Given the amount of mitigation to offset any impact from the pool/patio area, Agent stated <br /> the proposal meets performance standards. The lot will greatly benefit. <br /> A concern from abutter at 170 Captains Row is a runoff issue. He said this is an underlying <br /> issue and not directly related to the proposed project. <br /> Assistant Agent read comments from the abutter. <br /> Agent said we don't have anything on file for the pipe causing runoff issues. Now is a good <br /> time to address this issue. The abutter is concerned the pool/patio will exacerbate the <br /> existing runoff issues on to her property. In general, I don't have an issue with the pool and <br /> patio, but this runoff situation should be looked at. <br /> Mr.Colombo asked if the pool meets the setback requirements. <br /> Assistant Agent read Building Department comments. <br /> Agent said zoning typically sees ConCom's review. <br /> Assistant Agent asked how deep the pool will be. <br /> Mark Dibb answered it's about 4ft. <br /> Assistant Agent read Board of Health comments. <br /> Mr.Smith asked if there's a date to revisit application, or wait for applicant to come back <br /> once resolved? <br /> Agent asked if 3/10/22 was enough time to resolve the runoff issue? <br /> Mark Dibb said yes. He said there is a catch basin that gets overwhelmed by both ends of <br /> Captain's Row. The berm diverts the water, and the pipe allows a slower relief until that <br /> gets overwhelmed then overtop the cobblestones and heads towards the river. Not sure <br /> what the resolution would be but can certainly look into it. Pool proposal will not redirect <br /> more that way. <br /> Mr.Sweet said it's a serious problem but thinks it's how the property interfaces the road. <br /> Somewhere that village is not doing the right thing. We should not allow this until it is <br /> corrected. <br /> Agent said something needs to be done, but he doesn't endorse holding up this project, it's <br /> not fair to the homeowner. <br /> Mr.Sweet said he agrees, but this needs to get HOA attention. Needs a continuance to <br /> see if someone can look at this setup. <br /> Agent said he can reach out to the HOA. <br /> Assistant Agent said HOA did build a berm, but to no avail. <br /> Mr.Smith motioned to continue to 3/10/22 at 6:21pm. <br /> Mr.Dalton seconded the motion. <br /> Vote: 6-0-0 <br /> Roll Call Vote: <br /> Mr.O'Neill; yes <br /> Mr.Sweet; yes <br /> Mr. Dalton; yes <br /> Mr.Colombo; yes <br /> Mr.Smith; yes <br /> Mr.Weeden; yes <br /> In favor,6; Opposed, 0; Abstentions, 0 <br />
