This should be brought to the engineer's <br /> attention. <br /> He stated that on the Special Permit some dates are missing. <br /> Finding #4 -- acreage of open space should be 46. 48 not 44.9. <br /> Will be deeded to Cons Com, change wording to read Town of <br /> Mashpee. <br /> Finding #9 - clarify the section of Ashers 'Path as between <br /> Papane t Road and Rt e 28 , It is shown on the plan. <br /> There were no public questions or comments. <br /> Judy made a motion to close the public hearing. Wayne <br /> seconded the motion. All Board members were in favor. <br /> Judy made a motion to approve the Special Permit. Wayne <br /> seconded the motion. All Board members were in favor. <br /> Judy made a motion to approve the definitive plan for <br /> Asher ' s Heights . Wayne seconded the motion. All Board <br /> members were in favor, <br /> APPROVAL RIOT RE UIRED PLAN <br /> Applicant: Daniel C. Hostetter <br /> Location: Willowbend project <br /> Request: Reference to covenant on 1-lot ANR. <br /> Tony Ferragamo stepped down. <br /> Kevin Kirrane was present representing the applicant. <br /> The Board explained that they discussed this with Town <br /> Counsel who said they will need a summary from the appl i c ant <br /> itemizing work which has been completed which is considered <br /> substantial . <br /> Mr. Kirrane did present a summary to the Board of what the <br /> applicant considers to be substantial work on the site and <br /> substantial action on each of the phases. <br /> He drafted a letter, as written confirmation, relating to <br /> these issues and the status of the Special Permit. <br /> Tom stated that the Building Inspector makes the final <br /> determination that there are no violations of the Special. <br /> Permit but the Planning Board has a lot to say about it. <br /> Mr. Kirrane stated that they plan to come back with a <br /> modified phasing schedule. <br /> Wayne made a motion to sign the letter. Pat seconded the <br /> motion. All other Board members were in favor. <br /> On the ANR, Judy explained that it is Mr. Reardon' s opinion <br /> that when modifying lot lines , it is a modification of the <br /> 'f Special Permit. <br /> Mr. Kirrane stated that it is just drawing line down middle <br /> they are not increasing lot line at all and both lots still <br /> comply. <br /> - 2 - <br />
