d <br /> Attorney Pat Butler brought a copy of the plan as recorded. <br /> He stated that he tried to depict what has been constructed <br /> to date - swimming pool, tennis court , 14 units (11 sold) . <br /> He gage a checklist of conditions required under the special <br /> permit (monitoring plan and conservation restriction) . <br /> He went through it with the Board to indicate where there <br /> has been compliance and where there are things outstanding. <br /> 1 . A-D Monitoring Plan - they intend to meet intent of that <br /> agreement. <br /> D $125 , 000 performance bond for sewage treatment plant <br /> nothing posted to date . Propose tonight an amendment to the <br /> phasing schedule and and propose that a $150 , 000 L/C to be <br /> posted at completion of phase 1. <br /> 2 . In compliance <br /> 3 . Discharge permit in compliance . <br /> 4 . No requests <br /> 5. Is not done, will form Homeowners Association as soon as <br /> possible. <br /> Tony stated that there is a discrepancy between documents <br /> given at last meeting and what is in the Planning Board <br /> files for conservation restrictions . <br /> Pat Butler believes that what they were handed at- the lest <br /> meeting is a draft document and after the Trustees agreed <br /> to it it was rewritten and that languags was approved. <br /> The present owners would have no problem granting the <br /> Conservation restriction in perpetuity to the the Trustee of <br /> Reservations . <br /> The documents to be drafted regarding open space: will <br /> clarify this issue. <br /> Mr . Butler will discuss this with the trustees . <br /> 6 . -Re-vegetation. Tony stated that the Board mould 1 ike to <br /> see the re-vegetation plan. The landscaper stated that An&a <br /> staked out and f illed -in the 40 f t set back f rom thv edge of <br /> the road. <br /> Tong stated that the 40 feet should be measured from the <br /> property line. <br /> 7 . Phasing schedule: <br /> Mr. Butler stated their proposal is to suspend cons tr uc t you <br /> at level they are at , they will then be given 6 months to <br /> commence construction and then be given 1 year from s ta;: t c,,�f <br /> construction to complete phase one , then month win►low to <br /> start construction and then one year to co+rrple to p1�.as�: two. <br /> Upon completion of phase 2 clubhouse will be completed. <br /> Balance of project will then go according to original <br /> timetable . <br /> Jahn sokolovlc stated they would like the 6 months to begin <br /> at the sale of the 14 units . <br /> Tony stated that there are a number of pr% j ects in t1ais '66e <br /> situation.
