MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> Daniel P. Wong and Kate D. Wong <br /> 71 Bluff Avenue (Map 118 Parcel 63) <br /> Mashpee, MA 02649 <br /> FINDING-2022-23 <br /> The proposed construction does not include any exterior work on the lot, and does not require <br /> Conservation Department approval,but is in their jurisdiction. The Board of Health submitted <br /> comments that if the addition is 70 sq. ft. or more it would require a 6 ft. cased opening to <br /> eliminate privacy. The Building Commissioner suggested not to exceed the 50%construction <br /> costs of the assessed value of the home. <br /> The Board had a discussion regarding the site plan and floor plan and requested that the <br /> applicant remove the proposed balcony, and provide the Board with a revised site plan. The <br /> Board also mentioned that the second floor plan depicted a 5.6 ft. cased opening, and should <br /> be revised to 6 ft. <br /> The Board of Health comments dated June,8,2022;"This property is in a Zone II and is restricted <br /> to the three (3) existing bedrooms with a conventional septic system. The system was upgraded <br /> in December 2021 and a COC was issued, so a septic inspection is not required. The addition of <br /> any heated room that is 70 sq. ft. or more would be required to have a 6' cased opening to <br /> eliminate the privacy. Otherwise, it would meet the definition of a bedroom and would be <br /> considered an increase in flow." <br /> GENERAL CRITERIA <br /> The subject property located at 71 Bluff Avenue is approximately 8,015 square feet. <br /> There were no abutters present. <br /> WRITTEN FINDING CRITERIA <br /> ARTICLE V -Nonconforming Buildings and Uses: <br /> §174-17. Continuance; Extensions; Alterations - Lawfully created structures or uses may be <br /> continued,although not conforming with the provisions of this chapter.Non-conforming single- <br /> or two-family dwelling structures may be changed,extended or altered if such change, extension <br /> or alteration complies with the dimensional requirements applicable to the lot under current <br /> provisions of§174-31 or,for lots which have been developed pursuant to§174-21,complies with <br /> such requirements as were applicable to initial construction of the dwelling under provisions of <br /> §174-21. <br /> z <br />
