Applicant: Bonwood/Southport <br /> Location: Old Barnstable Road <br /> Request: Continuation of discussion of provision of <br /> security for landscaping. <br /> Louise and Judy stepped down. <br /> Ron Bonvie and Mike Dunning were present. <br /> Before discuss this issue, Mike Dunning had a release of <br /> covenant signed by Tony without acknowledgement. It was a <br /> release for lot 296 of Ashumet Shores Section 2. <br /> Judy made a motion to release the covenant. Wayne seconded <br /> the motion. All Board members were in favor. <br /> Mr. Dunning explained to the Board that they were present to <br /> discuss the approval of phase II . The Planning Board had <br /> voted on Sept. 21 , 1989 to approve phase II subject to a few <br /> changes and submission of an Letter of Credit for $250 , 000 <br /> to quarantee performance of landscaping. <br /> Since that time Mr. Bonvie has had difficulty in getting the <br /> L/C because the Bank has come under the jurisdiction of the <br /> Bush bailout bill and Resolution Trust is administering <br /> the loan. The approval has been extended a few times and <br /> what Mr. Dunning proposed is that the Board approve the <br /> plans and insert a condition that no building permits can be <br /> issued until the L/C is provided. <br /> Tony stated that he would not agree with that. He might <br /> consider no building permits until work is completed. He <br /> needs time to consider his concerns . <br /> Mr. Bonvie stated that this work was not funded in the first <br /> phase and he cannot tie in into the first phase funding. <br /> He stated that the permit was unclear as to when the <br /> vegetation should have been completed. <br /> Mr. Dunning suggested have a 6 month conditional approval <br /> where the work must be done or an L/C is provided with a 6 <br /> month expiration so by the end of that 6 months either the <br /> work must be done or the L/C will be acted upon. <br /> Public Comments : <br /> Louise Behrman stated that as an abutter, this project is <br /> seriously effecting quality of life all on Algonquin Ave . <br /> The lack of screening will make the noise problems worse . <br /> They work at 6 in the morning and on Sundays . <br /> Mr . Bonvie stated that he owns all the equipment and they <br /> never do or never will work on Sundays . They have never <br /> started earlier than 7 : 00 am. There is no condition in the <br /> permit limiting time to begin work. They will not be doing <br /> any work or clearing in phase II in the near future, th,-y <br /> still have 1 1/2 years of work in phase I . <br /> - 9 - <br />
