Pat stated that he would like to see the seasonal aspect of <br /> this traffic report. This report assumes the beach traffic <br /> continues all year. <br /> Judy stated that the way this issue was left at the last <br /> meeting was that Mr. Connely was to prepare an explanation <br /> for Town Counsel why he thought he didn' t have to improve the <br /> Road. <br /> Louise stated that when asked specifically at the last <br /> meeting, Mr. Connely was saying they didn' t want to do <br /> anything at all to the Road. <br /> Mr. Connely stated that it is not necessarily a legally <br /> phrased issue . He and Town Council have already had <br /> disagreements on the issue of Back Road. <br /> The question is is the roadway which exists adequate to <br /> service a 9 lot subdivision. <br /> Tony stated that the Board has asked the applicant to <br /> demonstrate technically why the Road is adequate and then <br /> conclude with a statement from a qualified person stating <br /> his opinion and the reasons why it is adequate. <br /> Judy asked Mr . Connely is he is still of the position that <br /> Dr. MacDonald should not be required to make any <br /> improvements? <br /> Mr . Connely stated that he is relying on what he is being <br /> told, he is not an expert. <br /> Tom asked if the Board has decided whether it needs to be <br /> brought up to subdivision standards? <br /> Judy and Louise believe it should be brought up to <br /> subdivision standards . <br /> Louise would like to see an engineers reason whir it doesn' t <br /> have to be brought up to subdivision standards. <br /> Pat stated that at the on site visit they discussed the <br /> possibility that some standards could be waived. <br /> Charlie stated that he has not seen the drainage changes , he <br /> just discussed them on the phone with Mike McGrath. <br /> Tom asked the Board if , in order to test that the drainage <br /> is working properly, it be done after the roads are in or <br /> after buildings are done? <br /> He explained that there are legal technicalities , the Board <br /> looses control when the covenants are released, so it should <br /> be done before any final security is released. <br /> Mr. Connely stated that there are still provisions of the <br /> draft special permit language that have not be agreed upon. <br /> Judy made a motion to accept request for an extension to <br /> February 23rd and continue this discussion until February <br /> 21st at 7 : 00 . Louise seconded the motion. All Board <br /> members were in favor. <br /> - 8 - <br />
