He stated to the public <br /> that the Planning Board and Town Planner are in support of <br /> this article. <br /> Discussions <br /> Applicant: Malcolm MacDonald <br /> Location: Back Road <br /> Request: Discussion of Water Quality and Special permit <br /> drafts. <br /> Attorney John Connely was present representing the <br /> applicant. <br /> He explained to the Board that Dave Warden, limnologist, had <br /> done an analysis of the Horsley Witten Hegeman study and met <br /> with Tom Fudala to discuss some of the issues . <br /> The primary issue was what were the effects on Moody and <br /> Johns Ponds . It was the applicant 's opinion there were no <br /> effects as relates to phosphorus and Mr. Warden agrees with <br /> the applicant. After their meeting, Tom Fudala agrees that <br /> phosphorus is not an issue based on the mitigating measures <br /> and design of subservice runoff water treatment at the site . <br /> Mr. Connely explained that they have created a leaching pipe <br /> because of Charlie' s concerns regarding the "bubbler" . <br /> The second issue was nitrogen and how it would impact <br /> Wilquoit Bay. Mr . Connely stated that they attempted to <br /> arrive at a water monitoring program that would take that <br /> into consideration. They have agreed to give the Town an <br /> easement to test well number 5. It would be maintained by <br /> the applicant and annually, tests would be run to determine <br /> the effect of nitrogen and test for whole nitrogen and <br /> dissolved oxygen. <br /> Tom stated that what was discussed is that the Town would <br /> have access to all 9 test wells on the site for future <br /> monitoring on the Town' s behalf. Well 5 would be improv,-,, <br /> (upgraded and covered) then tested annually by the develo_ ar <br /> and his heirs and they would be responsible for monitoring <br /> of nitrogen and dissolved oxygen. <br /> Judy asked if the easement will be to all of the monitoring <br /> wells? <br /> Louise is concerned that the timetable for all monitoring <br /> programs should be approximately the same. <br /> Tom stated that they have not settled on whether or not <br /> there is a standard for nitrogen that will be put into this <br /> document. He should be able to arrive at a standard. <br /> - 6 - <br />
