Mrs. Antunes can, then <br /> appeal the permit. The Beard does not want to write a permit <br /> that will not stand up in court. <br /> It is Town Counsel 's opinion to place the restriction if the <br /> applicant is willing. <br /> The Board would not write a decision that the applicant is not <br /> agreeable to. <br /> Judy explained that the Board will close the pubic hearing and <br /> they have 90 days to write the special permit decision. <br /> This gives Mrs. Antunes time to think about and investigate her <br /> options (regarding lot 4 restrictions) . <br /> The Board and applicant have agreed to include shared driveways <br /> for lots 2 and 3 and lots 4 and 5; lot S will be accessed on the <br /> proposed road (cul de sac) and graduated road standard for the <br /> proposed road. <br /> Louise made a motion to close the public hearing. Wayne seconded <br /> the motion, All Board members were in favor. 5-0. <br /> Wayne made a motion to approve the special permit with the <br /> conditions previously mentioned. Louise seconded the motion. <br /> Wayne, Louise, Judy and Spyro voted in favor, Pat Coffey voted <br /> against. 4 in favor' 1 against. <br /> The applicant will return with the definitive plan. The profile <br /> will not change, it will be in a definitive format. <br /> Louise made a motion to continue the public hearing for the <br /> definitive plan to December 18th at 8:30. Wayne seconded the <br /> motion. The deed <br /> description is vague and his attorney suggested having a plan <br /> with boundary lines drawn. <br /> Holmes and McGrath prepared the plan for him. <br /> It is an existing lot. <br /> Tony stated that it as more than the minimum amount of frontage <br /> to be considered a lot.
