Chair Baumgaertel also proposed a mask mandate in medical facilities and pharmacies throughout the <br /> Town, due to the current surge and the fact that vulnerable populations have no choice but to visit these <br /> facilities. After a lengthy discussion among the Board members,with input from the Health Agents, it was <br /> decided that, in lieu of a mask mandate, a notice should be published in the newspaper and posted on <br /> the various social media sites,etc.reminding residence that the BOH recommends folks should be wearing <br /> a mask regardless of vaccination status when in Mashpee business establishments or at any type of <br /> gathering. <br /> 2. Santuit Pond Survey Update and (moved from New Business)Title 5 Failures in Phase 1 Sewer Project. <br /> Mr. Harrington commented that 14 properties still had not complied with either the pumping or septic <br /> inspection order. Per the Board's last meeting decision to issue fines after January 6, 2022, those <br /> properties in violation will receive fine letters for$100/day until compliance is met. <br /> The Sewer Commission provided an updated map for Phase 1 and Phases 2A-2E. Phase 1 has an <br /> anticipated completion date of 2024-2025, and Phases 2A-2E have a completion date of 2026-2027. <br /> Mike Rapacz, Sewer Commission Chairperson, was present at the meeting. Mr. Harrington inquired if <br /> construction would occur simultaneously on all sections of Phase 2. Mr. Rapacz responded that the Sewer <br /> Commission is hoping that, by the time they reach Phase 2, part of the requirement for whatever company <br /> they hire will be to have multiple crews going simultaneously. Mr. Harrington asked if there is a discharge <br /> solution for Phase 2E now that Otis had been ruled out, and Mr. Rapacz outlined three possible scenarios. <br /> Mr. Harrington requested a map of the remaining three phases,once that is available. <br /> Discussion ensued about the status of properties with failed systems who were included in Phase 1 of the <br /> sewer project. Rather than require those systems to be upgraded, and then require the homeowners to <br /> connect to sewer in as few as four years, Mr. Harrington suggested that the Board may want to grant <br /> extensions, as provided in Title 5, for up to five years from the date of inspection. It was recommended <br /> that those extensions be granted on a case-by-case basis for properties in Phase 1, where a fiscal <br /> commitment and sewer plan is in place. The owner would still be required to maintain the system so that <br /> it doesn't break-out to the surface or back-up into the house,creating an imminent health hazard. In that <br /> case, the Board could take action to shorten the timeframe, and require the property owner to <br /> upgrade/repair the system. Pumping on a weekly or monthly basis can be very costly, so not all <br /> homeowners will want to seek an extension. There are also three technologies that can be used to help <br /> a leach field work hydraulically again. <br /> Chair Baumgaertel indicated that he would like the Board to begin reviewing the failures in Phase 1. Ms. <br /> Willander asked if they were being considered for extensions or merely reviewed for information <br /> purposes, and Chair Baumgaertel indicated that an extension could be granted through an enforceable <br /> agreement in the case of a property transfer. Mr. Harrington felt that the market may drive repairs to be <br /> made,versus requests for extensions. Chair Baumgaertel asked if Title 5 allows for a five-year extension <br /> from the date of inspection or a five-year extension from the initial two-year timeframe to upgrade, and <br /> Mr. Harrington indicated that he believed it was five years from the date of inspection. <br /> Ms. Patel expressed concern that the dates for Phase 2 sounded ambitious. Chair Baumgartel asked if <br /> Phase 2 was going to be proposed at Town Meeting as five separate areas with five separate warrant <br /> articles, and Mr. Rapacz answered that they would be presented as a package and they would be asking <br /> for 25% funding. Mr. Harrington stated he was not sure if 25% would be considered a full fiscal <br /> commitment to justify extensions allowed by Title 5 for failures identified in Phase 2 moving forward. <br /> Chair Baumgaertel gave Mr. Rapacz a brief overview of I/A technologies, and their associated approvals. <br />
