3. 9 Attaquin Street. Mr. Harrington commented that a request for an appeal of the order to pump and <br /> inspect the septic system at 9 Attaquin Street had been submitted. The owner requested a continuance <br /> from the last meeting of December 16, 2021, and was not notified of this meeting date; therefore, Mr. <br /> Harrington requested that the matter be continued until the next meeting. <br /> There being no further comments or discussion, Kripani Patel moved to continue the hearing for the <br /> request of appeal at 9 Attaquin Street to the next Board meeting. Motion seconded by Ernest Virgilio. <br /> Roll call vote: Ernest Virgilio (yes); Kripani Patel (yes); Brian Baumgaertel (yes). VOTE: Unanimous (3-0). <br /> NEW BUSINESS <br /> 1. Choke-Saver Requirements for Food Establishments. Mr. Harrington commented that any food <br /> establishment which seats 25 or more people is required to have an employee who is certified and can <br /> provide choke-saving assistance to people in a choking situation. Prior to transitioning to our current <br /> online permitting system, food establishment owners had to check a box on their renewal application <br /> certifying that they met this requirement. With the onset of COVID, the training, which must be <br /> completed in-person, has not been readily available. Prior to the holidays, our office had reached out to <br /> the Cape Cod Medical Reserve Corp, who agreed to provide Choke-Saver Training here in Mashpee, free <br /> of charge, and many food establishments had committed to attending. With the recent surge in case <br /> numbers, it was decided that the training should be postponed until April, with the understanding that <br /> food establishments would be issued their 2022 permits, provided they agreed to send at least one <br /> employee to the Choke-Saver Training that will be offered in the spring. <br /> There being no further comments or discussion, Kripani Patel moved to postpone the Choke-Saver <br /> Training until April for food establishments with seating of 25 or more, and to issue their 2022 permits. <br /> Motion seconded by Ernest Virgilio. Roll call vote: Ernest Virgilio (yes); Kripani Patel (yes); Brian <br /> Baumgaertel (yes). VOTE: Unanimous(3-0). <br /> 2. 58 Buccaneer Way. Mr. Harrington commented that,on December 28,2021,the Board of Health received <br /> a complaint regarding a large number of boxes being placed on the property. A picture was emailed to <br /> our office, and was forwarded to Board members. On January 4, 2022, the Code Compliance Inspector <br /> visited the property to verify the complaint, where he took pictures for documentation. Mr. Harrington <br /> stated that he also visited the property on January 4th, where he observed no garbage or organic matter, <br /> and no odor. The concern is that the longer the boxes are exposed to the weather, the more they will <br /> break down and the contents will be damaged. The material will be taken away as refuse if the Town has <br /> to clean up the property. <br /> Lynda LaMagna,the tenant at the property, introduced herself for the record. She explained her situation <br /> to the Board, indicating that she had no choice but to have the items deposited in her back yard, because <br /> she had been given very little notice that she had to remove the items from the property where they were <br /> previously stored. Additionally, she had not had access to the basement of her residence at Buccaneer <br /> Way since June 2021, when she discovered the key no longer worked and the lock had been damaged. <br /> The items in the yard belonged to her recently deceased husband and, while much of it would likely end <br /> up being sold, donated or thrown away, some of the items had great sentimental value to her, and she <br /> needed time to go through the boxes. She asked for patience while she navigated some financial problems <br /> she was experiencing as a result of being a recent widow and ongoing issues with her current landlord, <br /> Harold Giancola. She indicated that, as soon as she was able to, she was going to have movers relocate <br /> everything to a storage facility but, in the meantime, it was her intention to go through the boxes, breaking <br /> each one down as she did,and moving the items into the dwelling until she determined what she intended <br /> to keep and what would be discarded. <br />
