Review of Fines—58 Buccaneer Way. Mrs. Willander commented that, in a letter dated March <br /> 11,2022,the property owner, Harold Giancola,was notified via first class,certified,and electronic <br /> mail that, on March 3, 2022, the Board of Health voted to impose fines of$4,125 for failure to <br /> comply with an order to install risers on the septic components at his property at 58 Buccaneer <br /> Way. In a letter dated May 12, 2022, Mr. Giancola was notified via first class, certified, and <br /> electronic mail that, on May 5, 2022, the Board of Health voted to impose fines of$28,300 for <br /> failure to comply with an order to repair a clogged laundry line. In a separate letter dated May <br /> 12, 2022, Mr. Giancola was notified via first class, certified, and electronic mail that, on May 5, <br /> 2022, the Board of Health voted to impose fines of$375 for failure to comply with an order to <br /> repair/replace a broken lock on the bulkhead to restore the occupants access to the basement <br /> and electrical panel. Each of the three fine letters stated that fines were due within 10 days of <br /> receipt of the letter; however, no payments have been received by this office. We have not <br /> received the certified green cards;however, Mr. Giancola's attorney has also requested and been <br /> provided with copies of the fine letters. <br /> Mr. Baumgaertel inquired if this will be sent to Counsel to which Mr. Harrington confirmed it will <br /> be. <br /> There being no further comments or discussion, Kripani Patel moved to authorize the Health <br /> Agent to forward the matter of unpaid fines totaling $28,300 for outstanding violations at 58 <br /> Buccaneer Way to Town Counsel for collection action. Motion seconded by Brian Baumgaertel. <br /> Roll call vote: Kripani Patel (yes); Brian Baumgaertel (yes). VOTE: Unanimous(2-0). <br /> 2. Review of Cross-Jurisdictional Sharing Commitment Letter. Mr. Baumgaertel raised concern <br /> about reviewing the commitment letter as a conflict of interest given that he is a Barnstable <br /> County employee. Mr. Harrington confirmed that it would be a conflict of interest for Mr. <br /> Baumgaertel to participate in the review and thus were left without a quorum due to the absence <br /> of Mr.Virgilio during the meeting. <br /> f <br />
