Status of septic failures around Santuit Pond. Mrs. Willander commented that, when the Board <br /> last discussed the status of the properties with failed septic systems that were identified during <br /> the Santuit Pond Survey,it was prior to the May Town Meeting and before the Select Board voted <br /> to withdraw the article to fund the 25% design plan for Phase 2. At that time, I believe we were <br /> all anticipating that funding would be approved and that, per its authority under 310 CMR <br /> 15.305(1)(b), the Board could utilize enforceable agreements to extend repair timeframes for <br /> those systems beyond the two years stipulated in Title 5, with certain requirements to pump the <br /> system at a frequency that would prevent an imminent health hazard,and to tie into sewer within <br /> five years. Those extensions could only be granted if there was a fiscal commitment and plan in <br /> place to sewer those areas, which is not currently the case. The first round of the Santuit Pond <br /> Survey Order Letters were dated September 9, 2021, which could mean that, in a few months, it <br /> will already have been a year since some of those failures were identified, and no orders to <br /> repair/upgrade those failed systems have been sent out by this office. In fact, it was the <br /> recommendation of the Board and the Health Agent that no action be taken until the status of <br /> the sewer plan for that area was determined. <br /> Ms. Willander stated that, where we do not know the status of the sewer phases—whether the <br /> Town is still considering altering the Comprehensive Plan to facilitate sewering of the area around <br /> Santuit as part of Phase 2—nor are there any guarantees that funding will be approved;and where <br /> we now have to consider the implications of proposed amendments to DEP regulations relative <br /> to nitrogen sensitive areas, the Board should render an opinion as to when and how to address <br /> these failures(22 failed,—7 cesspools). <br /> During a conversation with Town Engineer, Ray Jack, he indicated that he is going to propose to <br /> the Sewer Commission that the comprehensive plan include the areas around the ponds as Phase <br /> 2, and he anticipates that sewers would be available in those areas in 2026. <br />
