Kevin Flaugherty,engineer, introduced himself for the <br /> record and answered questions from the Board. <br /> There being no further comments or discussion, Brian Baumgaertel motioned to approve the <br /> septic design plan for 17 Overlook Knoll 0rive with the following conditions: 1) a note shall be <br /> added to the plan indicating there shall be no planting or soil excavation within five feet of the <br /> SAS following installation; 2) the porch steps shall be moved to a position that will restrict <br /> pedestrian traffic from compacting the top of the SAS; 3) a note shall be added indicating a <br /> variance has been granted for the setback, Motioned seconded by Ernest Virgilio. Roll call vote: <br /> Brian Baumgaertel (yes); Ernest Virgilio(yes),VOTE: Unanimous(2-0) <br /> 12, Review of Nitrogen Aggregation Plan — 27 Aunt Janes Road. Ms. Willander commented that a <br /> Nitrogen Aggregation Plan (NAP) has been requested for a -bedroom dwelling that is currently <br /> under construction at 27 Aunt Janes Road. In 2014, a previously approved NAP removed 17,300 <br /> SF of credit land from this parcel, leaving enough land/square footage for two (2) bedrooms, In <br /> February 2022, a previously approved NAP added 8,000 SF of credit land to this parcel, adding <br /> enough land/square footage for three(3)bedrooms, In July 2022,a Certificate of Compliance was <br /> issued by the BOH for a newly installed septic system, designed for four (4) bedrooms, but <br /> permitted for three (3). The NAP before you proposes to utilize 10,000 SF of open space area <br /> within the Childs River East subdivision as credit land to obtain the 4 ,000 square feet required <br /> area for four(4)bedrooms,so that the property owners have the option of adding habitable space <br /> over the garage, should they choose to do so at a later time. The credit land survey plan and <br /> Grants of Title 5 Nitrogen Loading Restriction and Easement for the facility and credit land have <br /> been provided.A preliminary review of the plans and documents showed no issues encountered. <br /> Advance treatment is not proposed,as the full 40,000 SF is being provided. <br /> There being no further comments or discussion, Brian Baumgaertel motioned to approve the <br /> Nitrogen Aggregation Plan for 27 Aunt Janes Road with the following conditions: 1)the property <br /> is to be restricted to four bedrooms; 2)the draft grants of title 5 restrictions and easement shall <br /> be finalized and recorded at the Barnstable County Registry of deeds with an executed stamped <br /> copy provided to the Board of Health prior to issuance of the Certificate of Compliance; and 3) <br /> the 250 fee is to be paid prior to issuance of the Disposal Works Septic Permit, Motioned <br /> seconded by Ernest Virgilio, Roll call votes Brian Baumgaertel (yes); Ernest Virgilio (yes), VOTED <br /> Unanimous(2-0) <br /> 13e Review of compliance: Failure to maintain required agreement-1 The Paddock Circles <br /> s, Willander commented that, in the interest of time, this matter could be continued to the <br /> next meeting. <br /> There being no further comments or discussion, Brian Baumgaertel motioned to continue <br /> discussion of the failure to maintain the required O&M agreement at 129 The Paddock Circle to <br /> the next meeting, Motion seconded by Ernest Vigilio, Roil call vote: Brian Baumgaertel (yes); <br /> Ernest Vigilio (yes). VOTE: Unanimous(2-0) <br /> 14m Review and approval of draftLandfill Inspection report® Ms. Willander reported that, on April <br /> R, 2022,Tighe & Bond performed an inspection of the capped landfill at Asher's Path, per their <br /> contract with the Town.The inspection report,dated July 29,2022,was submitted to the BOH for <br /> certification. The report made the following recommendations for corrective action: 1) tree <br /> growth and other woody vegetation on the western extent of the capped landfill should be <br /> removed to prevent damage from root growth; 2) rebar used to install erosion controls around <br /> the capped landfill should be removed and the integrity of the capped landfill should be <br />
