7. Review of Septic Design Plan—31 Warwick Way. Ms. Willander commented this is a repair with
a variance requested to the three-foot maximum cover requirement. The plan shows a 19-foot
setback to the SAS from the foundation with no variance request; however, the SAS is below the
cellar wall due to the grade of the backyard. Chair Baumgaertel was concerned with migration of
gasses into habitable space, and stated that a 20-foot setback is still the requirement when the
SAS is below slab grade. He stated that the setback should be 20 feet or a liner should be added.
There being no further comments or discussion, Chair Baumgaertel motioned to approve the
septic design plan for 31 Warwick way with the condition that the SAS setback be increased to 20
feet or an impervious liner be provided to prevent migration of gasses to livable space in the
home. Motioned seconded by Ernest Virgilio. Roll call vote: Brian Baumgaertel (yes); Ernest
Virgilio (yes).VOTE: unanimous(2-0).
8. Review of Septic Design Plan — 46 Cranberry Ridge Road. Ms. Willander commented that no
variances were requested with this plan. Chair Baumgaertel asked when original system was
permitted, as he is concerned with the location of the sunroom. The tank looked to be
approximately three-feet from the sunroom and, at some point, an approval was pulled for the
sunroom. He was of the opinion that the plan should not have been approved with tank right so
close to the sunroom. Mr. Virgilio agreed the matter should be continued until a review of file
could be done and it could be determined by an engineer that the proximity of the tank to the
sunroom did not compromise the structural integrity of either.
There being no further comments or discussion Ernest Virgilio motioned to continue the review
of septic plan of 46 Cranberry Ridge Road to next meeting. Motioned seconded by Brian
Baumgaertel. Roll call vote Brian Baumgaertel (yes); Ernest Virgilio (yes).VOTE: unanimous(2-0)
9. Review of Septic Design Plan — 11 Hane Road. Ms. Willander commented that a three-foot
variance was requested to the three-foot maximum cover requirement. The plan shows the SAS
to be H-20 and vented.
There being no further comment or discussion, Ernest Virgilio motioned to approve the plan and
three-foot variance request for 11 Hane Road. Motion seconded by Brian Baumgaertel. Roll Call
vote: Brian Baumgaertel (yes); Ernest Virgilio. (Yes) VOTE: unanimous(2-0)
10. Review of Septic Design Plan—55 Surf Drive. Ms. Willander commented that this system profile
shows four feet of cover over SAS with no variance requested from 310 CMR 15.401(1)(B), Local
Upgrade Approval. Plan shows SAS to be H-20 and vented. Carmen Shay, engineer, introduced
himself for the record and said he will add needed information to plan.
There being no further comments or discussion, Brian Baumgaertel motioned to approve the
septic plan for 55 Surf Drive with the following conditions: 1)a note be added stating that garbage
grinder not allowed; and 2) a variance be requested from 310 CMR 15.401(1)(B). Motion
seconded by Ernest Virgilio. Roll call vote: Brian Baumgaertel (Yes); Ernest Virgilio (yes). VOTE:
Unanimous(2-0)
11. Review of Septic Design Plan—17 Overlook Knoll Road. Ms.Willander commented that this plan
is a tear down rebuild, with no increase of flow proposed. Plan shows six-foot setback from
foundation to the SAS, with a liner proposed as mitigation. When designer dropped off plan he
indicated this technology allows for reduction in setback. The application came in with an installer
listed Andrew Nixon, he is not permitted to install in Mashpee. Mr. Nixon will needs to take our
