Leach Revocable Trust Pg.: 48 <br /> 18 Overland Road (Map 114 Parcel 87) <br /> Mashpee, MA 02649 <br /> A Petition was filed on March 15, 2022 by Owner, George R. Leach, Trustee requesting a <br /> Written Finding under §174-17 of the Zoning Bylaws to allow for construction of an <br /> attached garage, and addition, extension to a pre-existing non-conforming dwelling on <br /> property located in an R-3 Zoning District, Map 114 Parcel 87,Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter <br /> 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee,on March 25, 2022 and April 1, 2022 a copy of which <br /> is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday,April <br /> 13, 2022 at which time the following members of the Board of Appeals were present and <br /> acting throughout; Chairman,Jonathan Furbush,Vice Chairman,William Blaisdell,Board <br /> Members, Ron Bonvie, Scott Goldstein, and Norman J. Gould. <br /> Attorney Christopher Kirrane represented the application. Also present was a <br /> representative with Cape & Islands Engineering. The Attorney provided a site plan <br /> depicting two dwellings on the existing lot; 16 Overland Road and 18 Overland Road. The <br /> addition will only be for 18 Overland Road. This lot is approximately 32,100 sq. ft., and <br /> based upon the coastal storm flowage, will render the lot at 18,468 sq. ft., and is under the <br /> 20%lot coverage. <br /> Attorney Kirrane's written presentation explains the site as pre-existing non-conforming <br /> with three roads surrounding the property. The existing structure is setback less than the <br /> required 40 ft.from Monomoscoy Rd West(noted as a paper road),has 133.5 ft.of frontage <br /> from Stanley Rd., and Overland Rd, at 26.9 ft. The proposed addition is not getting any <br /> closer than what currently exists, but will be getting slightly closer to Monomoscoy Road <br /> West due to the unique shape of the lot. The existing lot coverage is 13.35%the proposed <br /> is 17.21%based on the land subject to coastal storm flowage. <br /> 1 <br />
