MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> Owner, George R. Leach, Trustee of <br /> The George R. Leach Revocable Trust <br /> 18 Overland Road (Map 114 Parcel 87) <br /> Mashpee, MA 02649 <br /> FINDING-2022-15 <br /> The application consists of a 20 ft. x 26 ft. addition on the Southeasterly side of the <br /> dwelling, and an approximate 16 ft. x 24 ft. addition on the Westerly side of the dwelling. <br /> The proposed additions will result in an increase in lot coverage from 7.7%to 9.9%. <br /> The Board read the Conservation Department, Town Engineer, and Board of Health <br /> comments into the record. <br /> Attorney Kirrane reviewed the Board of Health comments with Cape & Islands <br /> Engineering regarding the bedroom count and the capacity of the septic system. He <br /> commented that his client is willing to comply with any conditional requirements. <br /> Mr. Bonvie asked if the proposed work area is getting closer to the wetlands than what <br /> currently exists. Attorney Kirrane said; not any closer than the existing pool. <br /> Mark with Cape&Islands explained there's 104 ft. setback dimension of the existing house <br /> to the coastal bank, and 100 ft.setback from the 100 ft.buffer zone.The structure is getting <br /> 4 ft. closer, and was approved by the Conservation Commission. The proposed structure is <br /> 104 ft. away from the coastal bank. <br /> GENERAL CRITERIA <br /> The subject property located at 18 Overland Road is approximately 32,100 square feet. <br /> There were no more comments from the Board. <br /> WRITTEN FINDING CRITERIA <br /> ARTICLE V -Nonconforming Buildings and Uses: <br /> §174-17. Continuance; Extensions; Alterations - Lawfully created structures or uses may <br /> be continued,although not conforming with the provisions of this chapter.Non-conforming <br /> single- or two-family dwelling structures may be changed, extended or altered if such <br /> change, extension or alteration complies with the dimensional requirements applicable to <br /> the lot under current provisions of§174-31 or,for lots which have been developed pursuant <br /> to §174-21, complies with such requirements as were applicable to initial construction of <br /> the dwelling under provisions of§174-21. <br /> 2 <br />
