MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> APRIL 13, 2022 <br /> Attorney Kirrane said that the house is pre-existing in the 50 ft. buffer, and he doesn't <br /> believe that relief is required. <br /> Ms. Sangeleer commented that she agrees with Mr. Bonvie regarding flood plain, and that <br /> the water will run into the neighboring yards. <br /> Mr. Martin said with--all due respect to the Town Engineer. There's often confusion--- <br /> regarding the standards that are pertinent to river systems and inland flood zones, and have <br /> never applied to ocean situations.He said that FEMA allows alterations of flood zone areas. <br /> Dave agreed with Mr. Martin and believes the house is not in the flood plain. <br /> Sharon read the Board of Health comments dated April 13, 2022 into the record. <br /> Attorney Kirrane will comply with all the recommendations by the Board of Health. <br /> Attorney Kirrane officially requested a withdrawal of the Variance request. <br /> Mr. Bonvie made a motion that the Board accept the request of the withdrawal under <br /> Section 174-31 referencing the front, side setback, and lot size requirements. Mr. Gould <br /> seconded, yes. All were in favor. <br /> Mr. Bonvie made a motion that the Board issue a Special Permit to BEC MA Properties, <br /> LLC under §174-17.1 of the Zoning Bylaws to raze an existing single story residential <br /> structure and replace the same with a new two story residential structure on property <br /> located in an R-3 Zoning District, Map 111 Parcel 127, Mashpee, MA with the following <br /> conditions; <br /> 1. The Board has determined that the applicant meets all the conditions of a Special <br /> Permit under Mass General Law 40A Section 9. <br /> 2. Site Plan - 42 Spoondrift Way, Mashpee, MA.
