The Applicant has stated that the lot coverage calculations are not based upon the <br /> foundation, but of the first floor square footage of the proposed home. <br /> Mr. Gould seconded, no <br /> Mr. Goldstein, yes, <br /> Mr. Bonvie, no <br /> . Mr. Blaisdell, yes <br /> Mr. Furbush, yes. <br /> The Board voted three in favor, and two against. The Special Permit for 42 Spoondrift <br /> did not pass. <br /> 68 Uncle Edwards Road: Owners, Richard J. and Lara L. Devaney request a Written <br /> Finding under§174-17 of the Zoning Bylaws to allow for a deck alteration to a pre-existing <br /> non-conforming dwelling on property located in the Popponesset Overlay District and R- <br /> 3 Zoning District, Map 117 Parcel 205, Mashpee, MA. <br /> Mr. Richard Devaney represented himself for the project. He is replacing the old deck and <br /> increasing the square footage that extends 8 ft. toward the back of the house. He provided <br /> a site plan that depicts the deck located on the side of the existing dwelling, and the deck <br /> extension area toward the back of the lot. The lot size is 6,500 sq. ft. <br /> The Board had a conversation and determined that the lot coverage is currently 19.1%, and <br /> the lot size is under 10,000 sq. ft., within the Popponesset Overlay which means the <br /> applicant is allowed to increase the lot coverage up to 25%. The proposed deck will <br /> increase the lot coverage to 21.6%. <br /> Dave Morris explained that the applicant is adding to a non-conforming structure and <br /> therefore requires a Written Finding under Section 174-17. <br /> Ms. Sangeleer read the Conservation and the Board of Health comments into the record. <br /> There were no more comments from the Board or audience. <br /> Mr.Bonvie made a motion that the Board issue a Written Finding under§174-17 to Richard <br /> J. and Lara L. Devaney of 68 Uncle Edwards Road to allow for a deck alteration to a pre- <br /> existing non-conforming dwelling on property located in the Popponesset Overlay District <br /> and R-3 Zoning District,Map 117 Parcel 205,Mashpee,MA with the following conditions; <br /> 1. The Board has determined that the applicant meets all the conditions of a Written <br /> Finding under Mass General Law 40A Section 6. <br /> 2.
