MASHPEE ZONING BOARD OF APPEALS
MEETING MINUTES
APRIL 13,2022
3. Conditioned on all Town Department comments read into the record.
4. Conditioned that any changes to the plans will require the applicant to return to the
Zoning Board of Appeals.
Mr. Gould, seconded, yes,
Mr. Goldstein,yes,
Mr. Bonvie, yes,_
Mr. Blaisdell, yes,
Mr. Furbush, yes.
All were in favor of the Written Finding.
18 Overland Road: Owner, George R. Leach, Trustee requests a Written Finding under
§174-17 of the Zoning Bylaws to allow for construction of an attached garage, and
addition,extension to a pre-existing non-conforming dwelling on property located in an R-
3 Zoning District, Map 114 Parcel 87, Mashpee, MA.
Attorney Christopher Kirrane represented the application. Also present was Mark with
Cape & Islands Engineering. A site plan was provided depicting two dwellings on the lot;
16 Overland Road and 18 Overland Road. The addition will be on 18 Overland only. This
lot is approximately 32,100 sq. ft., and based upon the coastal storm flowage, this will
render the lot at 18,468 sq. ft., and is under the 20%lot coverage.
Attorney Kirrane reviewed the Board of Health comments with Cape & Islands
Engineering regarding the bedroom count and the capacity of the septic system. He
commented that his client is willing to comply with any conditional requirements.
The site is pre-existing non-conforming with three roads surrounding the property. The
existing structure is setback less than 40 ft. from the paper road noted as Monomoscoy Rd
West, and Overland Rd.The proposed addition is not getting any closer than what currently
exists, but will be getting slightly closer to Monomoscoy Road West due to the unique
shape of the lot. The existing lot coverage is 13.35%the proposed is 17.21%based on the
land subject to coastal storm flowage.
Mr. Bonvie asked if the proposed work area is getting closer to the wetlands than what
exists now. Attorney Kirrane said; not any closer than the pool.
Mark with Cape&Islands explained there's 104 ft. setback dimension of the existing house
to the coastal bank, and 100 ft. setback from the 100 ft.buffer zone. The structure is getting
4 ft.closer, but the Conservation Commission approved the project. The proposed structure
is 104 ft. away from the coastal bank.
6
