]lT1N <br /> Town of Maslzpee <br /> 16 Gi eat Xeck Poad Aorth <br /> N „ , Alaslipee,Massachusetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> SP-2022-17 <br /> Owners, Charles Horne and Doc.: 908932 <br /> Ellen Horne Ctf.: 168388 <br /> 58 Cayuga Avenue <br /> (Map 65 Parcel 9) <br /> Mashpee, MA 02649 <br /> A Petition was filed on March 25, 2022 by Owners, Charles and Ellen Horne requesting a <br /> Special Permit under §174-17.1 (Raze and Replace) and §174-33 (Setbacks from <br /> Wetlands) of the Zoning Bylaws to allow for a raze and replace of a pre-existing non- <br /> conforming dwelling on property located in an R-3 Zoning District, at 58 Cayuga Avenue, <br /> (Map 65 Parcel 9), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter <br /> 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee,on April 1,2022 and April 8,2022 a copy of which is <br /> attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday,May <br /> 11, 2022 at which time the following members of the Board of Appeals were present and <br /> acting throughout; Chairman, Jonathan Furbush, Board Members, Ron Bonvie, Scott <br /> Goldstein,Norman J. Gould, and Associate Member Sharon Sangeleer. <br /> Attorney, John McTernan represented the homeowners for a raze and replace project. At <br /> the last meeting on April 27, 2022, the Board and Town Engineer reviewed the plans and <br /> made some suggestions regarding the setbacks and dimensions depicted on the plans. The <br /> project was approved from the Conservation Commission at their meeting, however,they <br /> wanted to discuss the proposed changes that were suggested by the Board. <br /> The plans were revised and the proposed dwelling was moved 3 ft. from the side setback, <br /> and will improve the left side at 15 ft. 2.5 inches, and on the right side will improve at 15 <br /> ft. 3.5 inches. The setback from the front improved from 40 ft. to 43 ft. The setback from <br /> John's Pond remains compliant. The new dwelling will be a three bedroom code compliant <br /> house, and will have plenty of parking with a two-car garage and driveway. <br /> The Town Engineer had a discussion with the design engineer who revised the plan as <br /> suggested.
