MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Owners, Charles Horne and Ellen Horne <br /> 58 Cayuga Avenue(Map 65 Parcel 9) <br /> Mashpee, MA 02649 <br /> SP-2022-17 <br /> Chairman Furbush asked what the proposed setback was from the wetlands. Mr.McTernan <br /> said the setback is 23 ft. and the requested relief is in the amount of 27 ft. The height of the <br /> proposed dwelling is 26 ft. which is well under the 35 ft. requirement. <br /> The Board of Health comments were read into the record; "The proposed raze and replace <br /> of the existing dwelling requires the following tasks to be completed: A Disposal Works <br /> Construction Permit shall be requested via the online permitting, Permiteyes,to install the <br /> new septic tank and distribution per plans with the permit being issued to a licensed <br /> installer, an asbestos inspection of the existing dwelling by a private licensed asbestos <br /> inspector with abatement, if necessary, a rodent inspection by a BOH agent. The <br /> requirements shall be performed and submitted to the BOH prior to the issuance of the <br /> Building Permit. The existing septic permit states that a three-bedroom septic is provided. <br /> The property is in Zone II so the dwelling is restricted to three bedrooms. The floor plans <br /> depict three bedrooms." <br /> The Conservation Department comments were read into the record;"This project has been <br /> approved by the Conservation Commission. The Conservation Department requires the <br /> submission of two full sized copies of the revised plans for the final house configuration." <br /> The Town Engineer comments were read into the record; "All of the April 28, 2022 <br /> comments have been addressed by the applicant's engineer." <br /> The DPW Director comments were read into the record; "The applicant will need to file <br /> for a Curb Cut Permit from the DPW(Cayuga Ave is a Town road). One of the conditions <br /> of the permit will be to contain all storm water on site. The plan does propose installation <br /> of drywells/leaching catch basins for the driveway and roof runoff." <br /> GENERAL CRITERIA <br /> The subject property located at 58 Cayuga Avenue is approximately 14,073 square feet. <br /> There were no abutters present. <br /> SPECIAL PERMIT CRITERIA <br /> ARTICLE V -Nonconforming Buildings and Uses <br /> §174-17.1 Raze and Replace History: Added 10-15-2018 ATM, Article 16, approved by <br /> Attorney General 1-9-2019. <br /> 2 <br />
