MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JUNE 22, 2022 <br /> 35 Wilsons Grove: Petitioner, Robert T. Silliman requests a Written Finding under§174-17 <br /> of the Zoning Bylaws to allow for an extension, alteration of an existing deck on property <br /> located in the R-3 Zoning District and Popponesset Overlay District, Map 118 Parcel 87, <br /> Mashpee, MA. (Owner(s) of record: Robert T. Silliman, Anne Marie Colbrook, Frederick S. <br /> Silliman, and Helen Louis Capizzi.) <br /> Mr. Silliman is requesting to replace an old deck with a newer 10 x 20 deck. It will be less than <br /> 2 ft. high with one step, and will have railings, and a handicap ramp. It will be built on sono <br /> tubes. The lot coverage is expanding from 22.5% to 24.8% which is well within the 25% <br /> allowed in the Popponesset Overlay District. <br /> Mr. Morris mentioned that this application was brought before the Board back in 2016 when <br /> the percent lot coverage was 20%, and was amended in 2018 to 25%. He's expanding a non- <br /> conformity which is allowed under Section 174-17. <br /> Ms. Sangeleer read the Board of Health comments into the record; "the deck shall be <br /> constructed so that access is maintained to the septic tank and that no structural members are <br /> placed on the tank. Supports shall extend below the tank bottom so that no side-pressure is <br /> placed against the septic tank." <br /> There were no more comments from the Board or audience. <br /> Mr. Goldstein made a motion that the Board approve 35 Wilsons Grove, Petitioner, Robert T. <br /> Silliman request for a Written Finding under§174-17 of the Zoning Bylaws to allow for an <br /> extension, alteration of an existing deck on property located in the R-3 Zoning District and <br /> Popponesset Overlay District, Map 118 Parcel 87, Mashpee, MA. (Owner(s)of record: Robert <br /> T. Silliman, Anne Marie Colbrook, Frederick S. Silliman, and Helen Louis Capizzi.),with the <br /> following conditions; <br /> 1. The Board has determined that the applicant meets all the conditions of a Written <br /> Finding under Mass General Law 40A Section 6. <br /> 2. Certified Site Plan—Prepared for 35 Wilsons Grove, Mashpee, MA., Date: December <br /> 12, 2014, Scale: 1" = 20', Prepared by Eastbound Land Surveying, Inc., Stamped and <br /> signed by: Robb Sykes,No.: 35418, dated 1/12/2015. <br /> 3. Conditioned on all Town Department comments read into the record. <br /> 4.
