Town of Mashpee <br /> oar j%` �ti�� omfi2 16 Great Neck Road North <br /> f �a <br /> Mashpee, MA 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JULY 13, 2022 <br /> The Mashpee Zoning Board of Appeals held Public Hearings on Wednesday, July 13, 2022, at <br /> 6:00 p.m. in the Waquoit Room at the Mashpee Town Hall, 16 Great Neck Road North. <br /> Chairman, Jonathan D. Furbush, Board Members William A. Blaisdell, Ron Bonvie, Scott <br /> Goldstein, Norman J. Gould, Associate Members, George Ganzenmuller, Charlie Reidy and <br /> Brad Pittsley were present. Building Commissioner, David Morris was also present. <br /> Chairman Furbush opened the meeting at 6:00 pm and announced that the hearings were being <br /> televised live on Mashpee TV. He will take comments after each hearing. <br /> 69 Shoestrin Ba° Road: Petitioner, Southworth Mashpee Properties, LLC requests a Variance <br /> under §174-33 (Setback from water and wetlands) to allow for construction of a single-family <br /> residential structure on property located in an R-3 Zoning District,Map 77 Parcel 137,Mashpee, <br /> MA. <br /> Attorney,Jack McElhaney represented the Variance petition request for relief from the wetlands <br /> of a proposed new home.The home is being built within the 50 ft. setback at the top of the coastal <br /> bank as shown on the site plan that was issued to the Board. The home will be located 17 ft. at <br /> its closest point, with a 3 ft. high retaining wall, and a patio 2.5 ft. from the coastal bank. <br /> The Attorney gave a brief history of the lot that is part of the Shoestring Bay sub-division <br /> originally built in the 1980's. Shoestring Bay Road runs parallel to the bay into the coastal bank <br /> with a dozen other homes that are located on that street. The bank is located roughly 50-150 ft. <br /> off the seaward side of the road. The lots are very narrow and at the time the road was constructed <br /> this particular regulation did not exist. The 40 ft. frontage setback is off of Shoestring Bay Road, <br /> and 50 ft. setback off the coastal bank. The subdivision original consisted of 35 lots,and 32 have <br /> been built. The lot 69 Shoestring was constructed at the time the road was built. The site plan <br /> was approved by the Conservation Commission on June 23, 2022. They approved the 17 ft. <br /> setback and is the same requested relief from the ZBA. The order of conditions has not been <br /> processed but it was approved. <br /> The hardship conditions were created with the conditions of the site primarily the historical <br /> location in proximity to the coastal bank. The lot is irregularly shaped along Shoestring Bay,and <br /> there is an ancient way called Bryants Cove Road which is a no build zone of the golf course. <br /> The house meets all other setbacks,and the lot coverage is 10.4%which is below the requirement <br /> in the R-3 Zoning District. <br />
