PLANNING BOARD <br /> Town of M as hp ee <br /> PLANNING BOARD MINUTES: July 20, 1983 <br /> MEMBERS PRES ENT: Earle Marsters, Harold Collins, Michele Stone, Richardson Jonas <br /> MIMBERS ABSENT: Richard Terry <br /> CONSULTING ENGINEER: Charles L. Rowley <br /> TIKE: 8:10 p.m. <br /> I Mail <br /> Mr. Weinberg appeared before the Board and re4:xested that the Town map he revised <br /> to reflect his area of Land. on Rte. 28 and Turtleback Rd. as Commercial based on <br /> a court decision. Tie Board said they would get a rul.i.ng from Tom. Counsel and <br /> dictated a letter -to be sent to him. <br /> Attorney Kilroy came before the Beard with an approval not required which had <br /> been signed by Mr. Pederson in 19-61 , --The plan was for Lot 4 Quaker Run Rd. whi ch <br /> is in -an. R-2 zone and has a f ront age of 29 f eet. He f e It it was a non--conf o rming <br /> back' then and according to the provisions of the present zoning by-law it is a <br /> I-egal lot as it was in existence as of January -1:, 1977. He wished to have the- <br /> Board ratify the signature of Mr. Pederson -as his was the only signature on the <br /> plan and not the majority of the Board at 'that time. <br /> Mr. Marsters stated the lot was -not lawfully in existence on January- 1, 1977 as <br /> it was not a legal size lot then either, He' also said the plan was not legitimate <br /> as it was only signed by one member, <br /> Mr, Kilroy said one member can sign the plan if he had -the okay of the majority to <br /> do so, but the records don't go back that far to say whether he did or not but he <br /> assumes he did. <br /> Mr. Marsters said it wasn't a. Legal lot as it had less than the 50' frontage <br /> required by the State and as it' s an approval not required it has no protection. <br /> Mr. Kilroy said it was in compliance with the subdivision rules and regulations <br /> and has nothing to do with zoni ing laws.- - He said he spoke to Joe Reardon's secre- <br /> tary .and Harold Collins and Richard Terry and felt all it took was ratification <br /> of the Board of Mr. Pederson' s si.gnature. <br /> Mr. Marsters said he really doesn't have a problem as it' s a descent size lot, but <br /> they could open it up to appeal from someone. He felt it was a good size lot and <br /> if you put the house back far enough there would be no problem. Mr. Kilroy was <br /> concerned with placing it back too far and get too close to the wetlands. <br />
