Secretary called bank and found out Bornstein collected the <br /> money on or about 18JAN- 77 , Condition has not been corrected and <br /> Planning Board will tape steps to rescind approval. Town Counsel states <br /> that if this subdivision has , been built up in there the Planning Board <br /> will have a difficult time rescinding approval of lots subject to mortgages <br /> and separate ownerships . Mr. Blakeman points out that there maybe several <br /> unbuilt lots remaining and approximately ten uncompleted houses ; therefore, <br /> we have a chance to go after Bornstein inasmuch as ownership- is still being <br /> held by Jahn,-Bornstein. Drainage is critical -in that areas and we shall <br /> ins is t 'i t be taken care of. <br /> PLUBLIC. HEARING '-8PM New Entrance New Seabury <br /> Mr, Christopher Burden and Mr. William Warwick representing New Seabury <br /> Corporation on above subject and explained most thoroughly to abutters <br /> the location and effects new entrance may have on therm. No opposition <br /> recorded, Mr, Garland stated that based on his experience of going in <br /> and, out of that road for twelve years , he .honestly felt that a track p ark,114. <br /> in g 1 an e was not necessary at the moment. <br /> Other opinions asked for : None, <br /> Mr. Mars tern informed Mr. Burden matter would be -taken under cons ideration/ <br /> advisement and he would be informed of the outcome. <br /> 4 Mars ters , after '-discussion with Board, and- un.amimous ly agreed upon, <br /> a letter to New Seabury Corporation was dictated stating that the Mashpee <br /> Planning Board would approve definitive plan only after receipt of letter <br /> from them stating that they will reserve an area apposite the booth and <br /> will provide a parking lane for trucks in that area. 'if the Planning Board <br /> deems it necessary in the future. Upon receipt of such letter Planning <br /> Board will affix their signatures to plan.- <br /> NOTE : Planning Board is extremely concerned about truck parking area, <br /> and it would make the Planning Board look bad if a problem arose <br /> and it was not provided f or even though the p 1 an met with no <br /> opposition from abutters . <br /> Mr. Baxter of Baxter any. Nye , Inc. , representing Dorothy F, Morze, Trustee <br /> comes in with definitive plan and requesting a Public lilearing for next <br /> month, Filing fee in the amount of $320.GO accepted and deposit for same <br /> given-t Form C filled out. in duplicate and submitted. List of abutters <br /> presented. <br /> As regards 'this plan Mr. Terry questioned the 3-year theory of green area <br /> and Mr. Blakeman also asked if this would be a situation where we would loose <br /> the park in 3 years . Mr. Mar s t e r n doesn' t believe the town can loose it ; <br /> however , if no lots are sold in three years , he believes it can be re- <br /> claimed in that instance. Mr. Holmes will go over this before the next <br /> meeting . Plan to be reviewed to make certain we are covered under drainage <br /> e ulations .
