Town of Mashpee <br />16 Great Neck Road North <br />MASHPEE ZONING BOARD OF APPEALS <br />DECISION FOR A SPECIAL PERMIT <br />SP-2022-48 <br />Owners, Alden Hinds and <br />Lucas Hinds <br />525 Main Street <br />(Map 20 Parcel 48) <br />Mashpee, MA 02649 <br />Mashpee, MA 02649 <br />Bk.: 34942 <br />Pg.: 201 <br />A Petition was filed on September 22, 2022 by Owners, Alden Hinds and Lucas Hinds requesting <br />a Special Permit under §174-17.1 of the Zoning Bylaws to raze and replace an existing non- <br />conforming single family dwelling on property located in an R-5 Zoning District, Map 20 Parcel <br />48, Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br />Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br />the Town of Mashpee, on October 21, 2022 and October 28, 2022 a copy of which is attached <br />hereto and made a part hereof. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br />Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br />Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, November <br />9, 2022 at which time the following members of the Board of Appeals were present; Chairman, <br />Jonathan Furbush, Vice Chairman, William Blaisdell, Board Members, Scott Goldstein, Norman <br />J. Gould, and Associate Member, Robert Caggiano. <br />Attorney Christopher Kirrane represented the homeowners for their raze and replace project. The <br />property has one non -confirming aspect of the front yard setback. The proposed dwelling will meet <br />all other zoning criteria. The lot is 80,000 sq. ft. with 199.16 feet of frontage along Main Street. <br />There are no new non -conformities being created, and there will be plenty of parking. The dwelling <br />will be code compliant, and a new Title 5 Septic System will be installed. This project is an <br />improvement of what currently exists. The lot coverage is 2.5% and will increase to 4.8% which <br />is well within the allowed 20% lot coverage in the zoning district. The height of the building is 34 <br />ft. Attorney Kirrane mentioned that this is a five (5) bedroom septic system. The Board of Health <br />reviewed the initial plans that were submitted, and thought there were 7 bedrooms. There were <br />revised plans submitted to the Board of Health, and were approved for 5 bedrooms. <br />
