yy„ Town of Mashpee <br />16 Great Neck Road North <br />urr; <br />o- <br />Mashpee, MA 02649 <br />, <br />MASHPEE ZONING BOARD OF APPEALS <br />DECISION FOR A SPECIAL PERMIT <br />SP-2022-51 <br />Owners, BEC MA Properties, LLC <br />42 Spoondrift Way <br />(Map 111 Parcel 127) <br />Mashpee, MA 02649 <br />Doc.: 1390516 <br />Ctf.: 221878 <br />A Petition was filed on January 28, 2022 by Owners, BEC MA Properties, LLC requesting a <br />Special Permit under §174-17.1 of the Zoning Bylaws to raze an existing single story residential <br />structure and replace the same with a new two story residential structure on property located in an <br />R-3 Zoning District, at 42 Spoondrift Way, Map 111 Parcel 127, Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br />Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br />the Town of Mashpee, on March 25, 2022 and April 1, 2022 a copy of which is attached hereto <br />and made a part hereof. <br />Public hearings were held on March 23, 2022 opened but not heard. On April 13, 2022 the hearing <br />was opened and heard at which time at which time the following members of the Board of <br />Appeals were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Board <br />Members, Ron Bonvie, Scott Goldstein, and Norman J. Gould. <br />Attorney, Christopher Kirrane represented the owner for a raze and replace of an existing three <br />bedroom home that was built in the 1960's as well as a request for a Variance from the front yard <br />setback. The existing house is pre-existing non -conforming. The setback request is for 3.8 ft. <br />Variance, the proposed structure will be setback 34.7 ft. The existing structures are currently <br />1,939 sq. ft. with a lot coverage of 25.5% which is non -conforming. The proposed structures are <br />2,982 sq. ft. The Board raised some concerns regarding the Variance request for the front yard <br />setback, and lot coverage at the 30% range. The design team took a second look at the project, <br />and have redesigned the home, and the Variance request for the front yard is no longer necessary <br />because it now meets the 40 ft. setback requirement. The development team has reduced the size <br />of the structure, and the lot coverage is under 25%. This is based on the proposed 9,000 sq. ft. of <br />upland. The Variance request was withdrawn and a new redesigned site plan of the house was <br />submitted to meet the 40 ft. front yard setback requirement. <br />
