MASHPEE ZONING BOARD OF APPEALS <br />DECISION FOR A MODIFICATION OF SPECIAL PERMIT (SP-2020-14) <br />Petitioner, Steven P. Hynds <br />Owner of record: 11 Industrial Drive, LLC <br />89 Industrial Drive (Map 88 Parcel 27) <br />Mashpee, MA 02649 <br />SP-2022-52 <br />Upon conclusion of the Remand Hearing and consideration of the modified Special Permit <br />conditions proposed by the Applicant and appellant, the Mashpee Zoning Board of Appeals issued <br />the within Decision For Modification Of Special Permit (SP-2020-14) pursuant to the provisions <br />of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. Said <br />application for Modification of Special Permit was approved by vote of the Board subject to the <br />following conditions: <br />1. The Board has determined that the applicant meets all the conditions of a Special Permit <br />under Mass General Law 40A Section 9. <br />2. Site Plan: Project: 89 Industrial Drive, Mashpee, MA. Prepared for: 11 Industrial Drive, <br />LLC. Date: December 4, 2019, C-101, Revision date: 1/22/20 Revise parking, 2/10/20 Add <br />3' gravel strips, add ADA ramp, 3/2/20, add 31' x 198' boat and trailer storage area, <br />4/30/20: Add chicken coop, update fence location. Scale: 1" = 20', Prepared by: Cape & <br />Islands Engineering, 800 Falmouth Rd., Mashpee, MA. Signed by: Matthew C. Costa, <br />Professional Land Surveyor, and Raul Lizardi-Rivera, Professional Engineer. <br />3. Conditioned on all Town Department comments read into the record. <br />4. Conditioned upon the applicant installing twenty six (26), 7 ft. tall newly planted <br />arborvitaes setback 19 feet from the property line. This new row of trees shall be staggered <br />with the existing row of trees located closer to the chain link fence so as to provide <br />maximum screening. This new set of trees planted at 19 feet shall be Green Giant <br />arborvitaes. The 19-foot area along the southern end of the Premises where it abuts 13 <br />Nancy Lane (the `Buffer Area") shall be preserved as a natural vegetated buffer. The <br />applicant shall not (a) cut any trees, or (b) store any equipment, construction materials, or <br />any other materials in the Buffer Area. The applicant shall maintain the two rows of <br />screening trees in the Buffer Area in good condition and replace any trees that do not <br />survive. No structures of any kind shall be installed in the Buffer Area, including <br />underground. <br />5. Conditioned that the wording "and other allowed special permit uses" be stricken from <br />this proposal. <br />6. Any other requested "uses" other than what is proposed will be required to seek and <br />require a special permit approved from the Zoning Board of Appeals. <br />7. Conditioned upon the applicant to obtain approval from Charlie Rowley, Consulting <br />Engineer for the Town to review the subject plans, perform inspections, and final sign off <br />prior to the occupancy being issued. The applicant to provide a payment to the Town to <br />cover the consulting fees as necessary. <br />
