buyer wishes to accept responsibility for those repairs. An enforceable agreement has been <br /> prepared to mitigate the variance from the requirement that all repairs be made prior to the sale <br /> of the property. <br /> Joseph Anastos, the buyer of the property, introduced himself for the record. Mr. Harrington <br /> stated that a timeframe of 90 days is typically set for a full system upgrade, when the property is <br /> going to be used. In this case, it is just components,so a shorter timeframe would be justified. <br /> Mr. Anastos stated that he was passing papers on property the following Tuesday, and his <br /> intention is to raze the property, and replace it with a 3-4000 square foot three bedroom home, <br /> closer to the street, with a brand new septic system. Mr. Anastos indicated that he plans to <br /> demolish the house within the next 30-60 days. Mr. Harrington stated that the Board of Health <br /> would hold off on occupancy until the new system is constructed and a Certificate of Compliance <br /> is issued. He advised the applicant that a rodent inspection and asbestos inspection are required <br /> prior to tear down. Mr. Harrington confirmed for Mr.Virgilio that the property would have to be <br /> posted. <br /> Chair Baumgaertel was of the opinion that there still needed to be an enforceable agreement in <br /> place in case plans change. Mr. Harrington suggested that the Board condemn the dwelling so <br /> that the property cannot be used until it is razed and reconstructed. <br /> Mr. Harrington recommended that the Board move to grant the variance with the mitigation of <br /> an Enforceable Agreement, to be provided within 10 days, stating that the dwelling be <br /> condemned and not be reoccupied until a new septic system and new dwelling are constructed, <br /> and a Certificate of Compliance and Occupancy Permit for the new system and dwelling are <br /> issued. <br /> There being no further comments or discussion, Kripani Patel moved to approve the Title V <br /> variance for 36 Summersea Road, as presented by the Health Agent. Motion seconded by Ernest <br /> Virgilio. Roll call vote: Ernest Virgilio (yes); Kripani Patel (yes); Brian Baumgaertel (yes). VOTE: <br /> Unanimous(3-0). <br /> EXECUTIVE SESSION <br /> For the record, Mr. Harrington stated that no Executive Session was needed. <br /> NEXT MEETING <br /> The next meeting of the Board of Health was scheduled for Thursday, May 6, 2021 at 7:00 PM. <br /> There being no further business, Ernest Virgilio moved to adjourn the public session meeting of the Board <br /> of Health at 9:15 PM.
