culvert, but he is unsure of the timeframe for repair. The Board should look to Conservation for
answers.

Ken Klint, President of Seabrook Village Association, is on the line. He would like to see an interim
solution. The weather is getting warmer and last time the pond drained there were rotting fish,
and the smell was horrible. The water retainage structure has been undermined. He has seen
fiberglass sheeting with interlocking joints in areas of deterioration, such as Hamblin Pond. Water
was coming up and rising inside the culvert, it was concluded that was the problem. Putting more
sandbags on the top is not a fix. Sheeting can be pulled out later. This is an interim solution that
wouldn’t be an enormous expense and could happen quickly.

Mr. Virgilio agreed, it wouldn’t take much. He does not understand why Conservation can’t meet
and understand the circumstances of the problem here. He agreed with Mr. Klint, this is
temporary. There is a simple solution and nobody can tell him otherwise.

Mr. Baumgaertel stated this is an example of the intersection of two towns and different state
and local agencies, but muddies the water on who is responsible.

Mr. Virgilio asked if anyone was familiar with what was built down Sampsons Mill Rd. going into
Cotuit. He referenced a beautiful reconstruction of the same problem that is being dealt with
here. When he worked for the DPW that took years to obtain.

Donna Gallagher is on the line, she is an abutter. She notes it is very shallow and leaking. She lives
on the water and deals with the smell, mosquitos and other bugs, not able to sit outside, and
having to keep windows closed. She cannot use her yard and it will only get worse. This is a big
deal to her and anyone else close to the water. She has been keeping track of what’s been
happening. When it failed this past time she knows it’s because the left hand side. All you have to
do is get some estimates and at least find out. Plywood was put up and it actually work. Pulled it
out and put sand bags in.

Mr. Baumgaertel noted wastewater and infrastructure as criteria for the American Rescue Plan
Act (ARPA) funding, he is unsure if Mashpee received it from the federal government. The
Treasury Department is broadly interpreting that item, they are saying the municipalities get
broad latitude in those particular areas, as long as those align with clean water/drinking water
act. There might be some access for that funding to get a short term solution. The grant process
is waiting nine months before you even get an answer. This is contingent on Town Manager and
Select Board, but could be an avenue for funding for a temporary structure.

Mr. Harrington will look into this, he was unaware the funding could be allocated for such.

Mr. Virgilio mentioned the Cape Cod Commission (CCC) having money. He will make a phone call
tomorrow morning and ask questions. The county has money for the towns that work together
Cape wide to benefit the towns equally.

Mr. Harrington commented to make sure it is money that has a broader use to offset money that
is specifically designated to wastewater for sewage projects.

Mr. Baumgaertel mentioned the license plate fund through the CCC. Another resource,
Association of Preserve Cape Cod, where Andrew Gottlieb is the Director.

7
