<br /> <br />Mr. Baumgaertel noted this solidifies what Mr. Virgilio previously stated about ownership. Who <br />owns these containers, and who is moving what containers around? For the next meeting, the <br />Board can discuss and brainstorm changes, then have a Public Hearing for comment. <br /> <br />There being no further comments or discussion, Kripani Patel moved to approve Crocker Bros. <br />Container for a Refuse Permit for 2021, under the condition the check for the fine is received and <br />the trucks are inspected with proof of insurances. Motion seconded by Ernest Virgilio. Roll call <br />vote: Ernest Virgilio (yes); Kripani Patel (yes); Brian Baumgaertel (yes). VOTE: Unanimous (3-0). <br /> <br />7. Request for Reduced Refuse Hauler Permit Fee, My Cousin Vinny Junk Removal. Mr. Harrington <br />commented that the applicant is requesting a reduced fee for a small junk removal business. The <br />business was applying for a Business Certificate through the Town Clerkâs office when the Board <br />of Health reviewed it for sign-off. With no Refuse Haulers Permit, the certificate was held up until <br />they obtained the Haulers Permit. Mr. Harrington informed them of the $500.00 annual fee. They <br />asked if the Board would consider a reduced fee for a company with a single truck and trailer just <br />starting out. <br /> <br />Mr. Baumgaertel asked if the Board should follow up by adding an additional line-item fee for <br />haulers with less than five trucks. How would we keep track, do they have to report how many <br />trucks they have? <br /> <br />Mr. Harrington stated there is an online permitting system that identifies each truck, inspects <br />each truck, and ensures correct registrations and tags on each truck. He does not wish to <br />represent this company and they will be given notice, so the Board will wait for the company to <br />appear before them to speak their side. This fee has been in place since 1991. There are single <br />truck companies who work under the radar, this may be more appealing if a lesser fee was <br />proposed. Mr. Harrington would recommend the same fee used for sewage haulers at $100.00 <br />per truck. <br /> <br />There being no further comments or discussion, Ernest Virgilio moved to continue this discussion <br />for this particular request. Motion seconded by Kripani Patel. Roll call vote: Ernest Virgilio (yes); <br />Kripani Patel (yes); Brian Baumgaertel (yes). VOTE: Unanimous (3-0). <br /> <br />8. Review of Correspondence, Seabrook Village Association. Mr. Harrington commented that the <br />Board received correspondence regarding Red Brook Pond on Falmouth/Mashpee line where the <br />culvert has let go and the pond has drained. Copies were sent to the DPW and Division of <br />Ecological Restoration in Boston. Abutters have concerns over stagnant water. There have been <br />calls to the Town, he has spoken to Department Heads, Conservation, and both town <br />Administrators are aware. Conservation is heading the repair and permitting to get the culvert <br />fixed. <br /> <br />Mr. Virgilio thinks the Board should be able to have a position to enforce this. Permits can take a <br />long time. Given their positions, if they can be forceful, they need to be. How long will this take <br />to repair? <br /> <br />Mr. Harrington spoke with Drew McManus, Conservation Agent, to see if there was anything the <br />Board of Health could present as a declaration or emergent. Mr. McManus believed nothing from <br />the Board of Health would expedite this process. Conservation is going for grant funding to fix the <br /> 6 <br /> <br />
