<br />Mr. Harrington commented that a new donut shop is proposed in Mashpee Commons. The <br />applicants have provided all required documents, fees, but the on-site inspection has not been <br />performed. <br /> <br />Dante and his wife Jessica, owners of Duke’s Donut Works, are on the line and introduced <br />themselves for the record. They are excited but still have a ways to go, as they are still building <br />out. <br /> <br />Mr. Baumgaertel looked at the packet and asked if everything has been turned in. According to <br />Mr. Harrington, all documents have been submitted. <br /> <br /> Mr. Virgilio asked if there was outside seating. The response was no, there is not. <br /> <br />There being no further comments or discussion, Kripani Patel moved to approve Duke’s Donut <br />Works at 10 North Street for a New Food Establishment Permit with the condition the Health <br />Agent will perform inspection prior to issuance of permit. Motion seconded by Ernest Virgilio. Roll <br />call vote: Ernest Virgilio (yes); Kripani Patel (yes); Brian Baumgaertel (yes). VOTE: Unanimous (3- <br />0). <br /> <br />6. Review of Compliance, Crocker Bros. Container. Mr. Harrington commented that an order letter <br />was sent to the above company due to evidence of operating without a Refuse Haulers Permit. A <br />fine of $500.00 was included in that order letter. The violator applied for a permit that day, which <br />was approved, and a check for the fine was reportedly put in the mail yesterday. After inspections <br />of trucks are performed, approval is recommended. <br /> <br />There is nobody on the line to speak to this matter. <br /> <br />Mr. Virgilio inquired about the length of operation prior to the discovery. He also questioned the <br />requirements for name placement on containers and if they are numbered. He would like to <br />discuss certainty of owners as well as placement of containers, as this is concerning. <br /> <br />Mr. Harrington was the recipient of photos documenting evidence this week of a container in New <br />Seabury, prior to that he had no evidence. The containers must have name, address, and <br />telephone number visible. <br /> <br />Mr. Baumgaertel would like to add this to a future agenda, possibly next, to explore the refuse <br />rights for Mashpee and welcomes suggested changes. <br /> <br />Mr. Harrington will follow up on their insurances and he confirmed they are not storing any waste <br />in Town. <br /> <br />While reviewing the documents before him, Mr. Baumgaertel inquired about Cabral. <br /> <br />Mr. Harrington commented Taylor Cabral took over the property at 95 Echo Rd. where there was <br />that large pile of solid waste. Manny Cabral is now off the Deed. Containers from Cabral Container <br />Service were located on that property. They have since been relocated to 81 Echo Rd., which is <br />still owned by Manny. Taylor has no attachment to Cabral Container Services in business or <br />possessing actual containers. Mr. Harrington has asked Taylor to submit an E-mail stating such so <br />enforcements would cease. Per their last conversation, Taylor was using containers for demo <br />work and having other people move them for him. He is no longer using any Cabral containers. <br /> 5 <br /> <br />
