The rodent control and <br />asbestos inspections were performed and have been submitted with building permit application. <br />This variance has been granted before. Trying to move the septic tank and the electrical lines for <br />the pump would impact the tank and pump chamber. The membrane would address any odor or <br />effluent migration towards the foundation. Mr. Harrington recommends approval of the variance <br />with the conditions of a septic inspection to be performed and the reserve area shown on an <br />engineered site plan. <br /> <br />Brian Yergatian, BSC Group, introduced himself for the record. He is representing the applicant. <br /> <br />Mr. Baumgaertel asked if this was a raze and replace or addition. <br /> <br />Mr. Yergatian stated this is a raze and replace. <br /> <br />Mr. Baumgaertel asked if the lot was 44,000 s.f. <br /> <br />Mr. Yergatian stated 44,057 s.f. <br /> <br />Mr. Baumgaertel noted there needs to be an engineered plan for reserve area. <br /> <br />Mr. Harrington agreed one needs to be shown to bring into full compliance, as well as a septic <br />inspection, which are two requirements to Title 5. <br /> <br />Mr. Baumgaertel inquired if there needed to be a new plans showing the nitrogen sensitive zone <br />detail on this site plan. <br /> <br />Mr. Harrington noted it needs to be shown and put on record for Title 5 variance. <br /> <br />There being no further comments or discussion, Kripani Patel moved to approve the variance with <br />conditions of the septic inspection to be performed and the reserve area to be shown on an <br />engineered plan for 33 Sturgis Lane. Motion seconded by Ernest Virgilio. Roll call vote: Ernest <br />Virgilio (yes); Kripani Patel (yes); Brian Baumgaertel (yes). VOTE: Unanimous (3-0). <br /> <br />4. New Food Establishment Permit Application – 259 Shore Drive, Brownie’s By the Sea. <br />Mr. Harrington commented that a new pizza shop is proposed in the former Stelio’s Pizza in the <br />Marketplace. Mr. Brown has provided all required documents, fees, and the on-site inspection <br />has been performed. <br /> <br />David Brown, owner of the property, introduced himself for the record. He has a couple more <br />certificates he will be forwarding over next week. <br /> <br />Mr. Harrington noted it is a new owner who will have a similar menu to the previous <br />establishment. <br /> <br />There being no further comments or discussion, Ernest Virgilio moved to approve the application <br />for 259 Shore Drive, Brownie’s by the Sea. Motion seconded by Kripani Patel. Roll call vote: Ernest <br />Virgilio (yes); Kripani Patel (yes); Brian Baumgaertel (yes). VOTE: Unanimous (3-0). <br /> <br />5.
