MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JANUARY 11,2023 <br /> Mr. Reidy asked Mr. Colombo if the Commission has the same language "not more or less <br /> detrimental". Mr. Colombo said they do not have that language in the wetlands bylaw. He said he <br /> agrees with Mr. Morris when fill is brought into the flood plain. <br /> Mr. Morris said that if the pool is situated at ground level it is fine. <br /> Mr. Furbush asked Mr. Colombo if this particular project was a split vote from the Commission. <br /> Mr. Colombo does not recall and will look at the file. <br /> There were no more comments from the audience. <br /> Ms. Sangeleer read the Board of Health comments into the record; "Septic approved for 3 <br /> bedroom. Pest inspection is needed before demo." The pest inspection was performed on <br /> December 13, 2022. The Conservation Commission has approved the project. <br /> There were no more comments from the Board. <br /> Mr. Bonvie made a motion that the Board issue a Special Permit to Owners, Samuel and Cielo <br /> Ordonez under §174-17.1 of the Zoning Bylaws to allow for a raze and replace of a pre-existing <br /> non-conforming single family dwelling on property located in an R-3 Zoning District, and <br /> Popponesset Overlay District, Map 117 Parcel 328, Mashpee, MA with the following conditions. <br /> 1. The Board has determined that the applicant meets all the conditions of a Special Permit <br /> under Mass General Law 40A Section 9. <br /> 2.
