Mr. Baumgaertal asked if anyone had any comments on May 6, 2021 regular session meeting <br />minutes. There being no comments or concerns Kripani Patel motioned to approved the meeting <br />minutes for May 6, 2021 regular session. Ernest Virgilio seconded. Roll Call Vote: Kripani Patel <br />(yes) Ernest Virgilio (yes) Brian Baumgaertel (yes). VOTE: Unanimous (3-0) <br />Mr. Baumgaertel asked if there are any comments for meeting minutes from June 16, 2021 regular <br />session. There being no comments or concerns Ernest Virgilio motioned to approve the meeting <br />minutes from the June 16, 2021 regular session meeting. Kripani Patel seconded. Roll Call Vote: <br />Ernest Virgilio (yes), Kripani Patel (yes), Brian Baumgeartel (yes). VOTE: Unanimous (3-0) <br />Mr. Baumgaertel asked if there are any comments for the September 23, 2021 meeting. There <br />being no further comments, Kripani Patel motioned to approve the meeting minutes from <br />September 23, 2021 regular session. Ernest Virgilio seconded. Roll Call Vote: Ernest Virgilio (yes), <br />Kripani Patel (yes), Brian Baumgaertal (yes). VOTE: Unanimous (3-0) <br />2. Review and approval of expense warrants. Expense warrants were signed by Mr. Baumgaertel, <br />Mr. Virgilio and Ms. Patel. <br />3. Review of Nitrogen Aggregation Plan- 14 Pine Avenue. Mr. Harrington commented that a <br />nitrogen aggregation plan is being requested for the above property. 14 Pine Avenue is located <br />adjacent to Maushop Village in New Seabury. The open space area in the Seabrook Village <br />subdivision is to be used as credit land for the undersized property to obtain the additional land <br />for more bedrooms. In this case, 42,000 SF are being utilized to obtain the 50,000 SF required <br />area for five bedrooms. The credit land survey plan and Grants of Title 5 Nitrogen Loading <br />Restriction and Easement for the facility and credit land have been provided. The $250 review <br />fee has been paid. The plans and documents have been reviewed. The facility land restriction <br />and easement and the credit land restriction and easement were correct. <br />There being no further comments or discussion, Ernest Virgilio motioned to approve the Nitrogen <br />Aggregation Plan for 14 Pine Avenue with the following conditions, the draft grants of Title V <br />restriction and easement must be finalized and recorded at the Registry of Deeds with an <br />executed stamped copy provided to the Board of Health prior to issuance of the septic installation <br />permit and approval of the Building permit. Kripani Patel seconded. Roll Call Vote: Ernest Virgilio <br />(yes), Kripani Patel (yes), Brian Baumgaertal (yes). VOTE: Unanimous (3-0) <br />4. Show Cause Hearing, Kennel Regulation violations. On September 15, 2021, as a result of a <br />complaint of animal neglect, Health Agents performed a site visit to Positive Dog Training of Cape <br />Cod, located at 46 Nicoletta's Way, Unit 10. The establishment had no signage indicating the name <br />or nature of the business being conducted there. Health Agents spoke with the owner, Matthew <br />Noone, outside of the establishment. In the course of the conversation, it was learned that Mr. <br />Noone was operating a dog training business at the location. Mr. Noone admitted to not having <br />applied for a Kennel License, as required by the Mashpee Board of Health Kennel Regulation. Mr. <br />Noone stated that he had obtained a Business Certificate. He also stated that he was not <br />operating a dog boarding business. Mr. Harrington advised Mr. Noone to begin the process to <br />get a Kennel License through the Town Clerk's office, and Mr. Noone agreed to take care of that <br />immediately. Health Agents were not granted access to the interior of the establishment, so no <br />2 <br />
