inspection was performed. Mr. Noone agreed to give Health Agents access to the establishment <br />the following day, but left a voicemail the next morning cancelling the inspection. <br />At approximately 9 p.m. on September 15, 2021, Ms. Willander performed a site visit to the <br />establishment. At no time did she attempt to gain access. While outside the unit, Ms. Willander <br />heard barking coming from multiple dogs directly inside Unit 10. <br />On September 16, 2021, a Cease and Desist Order was prepared by the Board of Health and <br />posted at the establishment, and sent to Mr. Noone via First Class and Certified Mail. <br />At approximately 12 noon on September 17, 2021, Health Agents visited the establishment, <br />where they were met by the Property Manager, Charles Haratoonian. Animal Control Officer <br />Donald Chicoine arrived shortly thereafter. Health Agents and the Animal Control Officer were <br />granted access to the establishment by the Property Manager, and in the presence of Mr. Noone <br />and a woman who did not immediately identify herself or offer the nature of her relationship with <br />Mr. Noone. Mr. Haratoonian provided Health Agents with a copy of the portion of Mr. Noone's <br />lease related to his responsibility to secure all required municipal permits prior to operating. <br />An inspection of the interior of the unit was performed. The odor of animal urine and feces was <br />overpowering, and many flies were observed. In the course of the inspection, Mr. Noone <br />indicated that he had been operating at the location for 8-9 months, but had been in the dog <br />training business for about eight years and had been training dogs for over 20 years. <br />• Officer Chicoine asked if Mr. Noone had cleaned the space and removed animals and crates for <br />purposes of this inspection, and Mr. Noone stated that he had not. <br />• Mr. Noone again stated that he does not board any animals overnight. <br />• Mr. Noone stated that the dogs that were at the establishment overnight were his dogs. He later <br />changed his story, stating that one of the dogs was his and the other two dogs belonged to friends; <br />however, he could not recall his friends' names orthe names of the dogs, but stated that he would <br />provide that information to Health Agents later that day. <br />• Mr. Noone stated that the dogs were there overnight for training, and indicated that it is not <br />uncommon for him to train dogs, including police dogs in Boston, very late at night. <br />• Ms. Willander asked forthe name and breed of Mr. Noone's dog, and asked if the dog was licensed <br />in Sandwich to his home address. Mr. Noone provided the dog's name and breed, and reported <br />that the dog was licensed to him in Sandwich. <br />• Officer Chicoine indicated to Mr. Noone that a wellness check would need to be performed on all <br />three dogs that were present overnight at the establishment, and Mr. Noone agreed to schedule <br />that once he had the contact information for the owners of the two dogs that did not belong to <br />him. <br />Mr. Harrington recommended the board issue a fine of $100.00 for each dog that was on -site <br />being kept without a permit. Three dogs were heard when the Assistant Health Agent returned <br />to the property at night after the inspection. A fine of $300.00 should be issued for failing to <br />comply with the Board of Health Kennel Regulation. <br />
