Mr. Virgilio questioned why he has been operating for 10 months and we are only issuing a $300 <br />fine? Mr. Harrington commented that there isn't proof, besides Mr. Noone's word that he was <br />operating without a permit. Ms. Patel agrees that the fine should be more, she would like to see <br />a fine for the 3 dogs and an additional fine for operating without a permit. <br />Mr. Harrington offered to do more research to be able to fine Mr. Noone based on his entire <br />history in Mashpee. Mr. Harrington then offered to speak to the Town Manager and Town <br />Council on how best to approach this and how to get heavier fines to stick. Chair Baumgaertel <br />answered yes. He agreed that a conversation with the Town Manger should happen. Chair <br />Baumgaertel asked if there will be something added to the regulation to avoid this happening in <br />the future. Mr. Harrington agreed that the regulation needs to be reviewed. <br />There being no further comments or discussion, Ernest Virgilio motioned for Mr. Harrington to <br />request from the Town Manager and Town Council advice on how to further inforce the violations <br />at 46 Nicoletta's Way for more extensive fines. Discussion of Comprehensive Wastewater Management Plan and Coordination of Town Board <br />Activities. Chair Baumgaertel stated that this agenda item was requested by Selectman Gottlieb <br />and introduced him to the Board. Selectman Gottlieb introduced the chairman of the sewer <br />commission, Michael Rapacz, to begin the conversation about the phases and a timeline for the <br />wastewater management. Selectman Gottlieb stated the town Nitrogen Reduction Plan's purpose <br />is to assist both the ponds and estuaries in the Town. Mr. Rapacz stated that the revised plan <br />would help for the removal of nitrogen from the Popponesset watershed but also phosphorus <br />and nitrogen from Mashpee Wakeby and Sanuit Ponds. He also stated that the timeline has been <br />pushed up to get the plan moving quickly and the revised phase 2 is considerably larger than the <br />original plan. <br />Chair Baumgaertel, Selectman Gottlieb, Sewer Commission Chair and the Health Agent discussed <br />proposed details to the new phase 2 of the Wastewater Management plan. <br />The Chair of the Board of Health has asked to discuss the CWMP to determine a common message <br />to give to residents in regard to the implementation of the plan and its impact on septic systems <br />in the town. The timing of the five phases of the plan is critical to permitting of failed septic <br />systems. Application of the growth control bylaw will also effect the permitting of the properties <br />in the project area. Mr. Harrington recommended to get Counsel's help with the application of <br />the growth control bylaw but the Sewer Commission is also an enforcing authority so the training <br />should be done together. <br />NEXT MEETING <br />The next meeting of the Board of Health was scheduled for Thursday, November 81h at 7:00 PM. <br />There being no further business, Kripani Patel motioned to adjourn the public session meeting at of the <br />Board of Health at 7:17 PM and move into the executive session and not to return to the public meeting. <br />rd <br />
