Regarding the Board's request that he immediately remove his unauthorized exterior <br /> garden bed after having been requested multiple times to do so, he again refused saying <br /> he had not heard back from the Town Manager about his request to use the space. <br /> Relevant to this is the Town's Policy 8 regarding use of property ultimately being the <br /> Town Manager's decision. In response to question if he had got permission before he <br /> did the planting, he said No. <br /> 4. Regarding leaving the July 20th Board meeting before the relevant Agenda item came up <br /> to discuss his non-compliance (which had been moved from the June 15 th Agenda <br /> because he could not attend), he said he had company. <br /> • Following Mohamad Fand's comments and additional discussion, Lynn Harris moved that the <br /> Board's July 20, 2022 Vote of No Confidence, back-up documentation, and request for the <br /> Select Board's dismissal of Mr. Fand be submitted by the MCGAC Board Chair to the Select <br /> Board the next day, August 18, 2022. The motion was seconded by John Carter and passed <br /> unanimously. Mr. Fand explained that he joined the unanimous vote for his dismissal from the <br /> Board so that he could present his case to the Select Board. <br /> • Lynn Harris read Rule 24 of the community garden Rules& Regulations(enclosed with Minutes), <br /> citing the portion stating that the Committee has "...the duty of enforcing rules and making <br /> decisions regarding the Garden each year. They have the authority to resolve conflicts, refuse a <br /> plot to a gardener or dismiss a current gardener...". She moved that based on Mr. Fand's lack <br /> of cooperation and collaboration with the MCGAC Board as well as with the garden rules and <br /> responsibilities, he be dismissed from the garden and the use of his Plot #13. The motion was <br /> seconded by Frank Gallello and passed 4-2. Sheryl Carberry stated that she was not comfortable <br /> voting in favor without confirmation from the Select Board that such a decision is the sole <br /> responsibility of the MCGAC Board, but that if that were the case she would have voted to <br /> dismiss. Mr. Fand voted No. <br /> Additional New Business., <br /> • Lynn Harris suggested that plant labels be made for plant s in the Native Garden this fall. She <br /> noted that gardener Sandy DeRosa, a retired science teacher, might be able to work with high <br /> school students to have them research the plants and create the educational labels. Included <br /> in this project would be a site visit to the Native Garden and the Community Garden. <br /> • The Board reviewed and commented favorably on Lynn Harris's draft revision to the existing <br /> Rules & Regulations. The revision is based on some questions/issues raised by new gardeners <br /> that make sense to incorporate for clarity. Lynn will incorporate suggested edits and bring back <br /> to the September 21, 2022 Board meeting for consideration and potential approval for <br /> forwarding to the Select Board for their review and approval. It was thought that if the Select <br /> Board wanted to maintain current Rules & Regulations wording, this document could become <br /> an appendix and/or part of a welcoming packet. <br /> Lynn suggested that the Rules & Regulations be at the top of MCGAC website so that members <br /> readily understand their responsibilities to the community garden. <br /> Lynn also suggested that we leave a packet of Rules & Regs in the shed,and/or place in cubicles. <br /> • The Board of Directors listing on the website needs to be corrected and updated. <br /> • We will notify gardeners that official communication will be sent via email, not by mail or by <br /> text message. This may be information included in the Application if we choose to update it. <br /> 2 <br />
